If you're ever arrested by the Economic and Financial Crimes Commission (EFCC) or any law enforcement agency, remember that you have rights!
On Friday, I was at the Lagos State High Court for a matter and I had the opportunity to observe the case of (Name Withheld) v. EFCC. The defendant pleaded not guilty, but when the prosecution presented his statement, it became clear that he had incriminated himself. Two things stood out to me:
1. He lacked legal representation, which likely contributed to his precarious situation.
2. He appeared intimidated and seemed to have been coerced into making false commitments in his statement.
Ultimately, he was sentenced to one year in prison, and some of his assets were forfeited to the federal government."
• You have the right to remain silent and not answer questions without a lawyer present.
• You have the right to a lawyer of your choice, and if you can't afford one, the state will provide one.
• You have the right to be treated humanely and with respect.
• You have the right to be informed of the reasons for your arrest and the charges against you.
• You have the right to contact your family or a friend to inform them of your arrest.
Remember, stay calm and assert your rights!
Having a lawyer is crucial!
Don't answer any questions or sign any documents without a lawyer present.
A lawyer will help you understand your rights and options, and ensure that you're treated fairly throughout the process.
Protect Your Properties!
Make sure your lawyer also manages your properties and assets to avoid harassment and intimidation from law enforcement agencies.
A lawyer can help you:
• Protect your assets from seizure or forfeiture
• Manage your finances and transactions
• Ensure your properties are not illegally searched or confiscated
Don't waive your right to a lawyer, even if you're told it's just a "routine questioning".
A lawyer is your best protection against false accusations, mistreatment, unfair outcomes, and harassment.
Stay informed, stay safe, and know your rights! If you need a lawyer, ask for one immediately!"
