White House border czar Tom Homan previously acknowledged that Loomer “probably was” among numerous people who contacted ICE about Milo. But Homan said that ultimately did not matter because an immigration judge had already issued the removal order and ICE was simply carrying it out. He rejected the idea that Milo was deported because of his politics or received unusual preferential treatment. ([CNN Transcripts][4]) Milo now disputes the broader government narrative. He says the failure to appear was not simply him ignoring court. He says he did not know the proceedings were happening. And he is signaling that this may become a legal fight. In his own account, Milo specifically referred to “motions to reopen” and predicted that he will eventually return to the United States. ([The Spectator][1]) That possibility is legally significant because BIA precedent says leaving the United States under an in absentia removal order does not necessarily prevent an immigration judge from considering a motion to reopen based upon lack of notice. ([Department of Justice][5]) As of now, however, I have not found a publicly verifiable filing showing Milo has actually submitted that motion. So once again, we have reached the same point. Show us the paperwork. Show Us the File, Not the Spin The Go Right with Peter Boykin Perspective I have been saying since this story began that I am not interested in joining Team Milo or Team Laura. Milo and I definitely have not always seen eye to eye. He blocked me on X. He has said things I found offensive, and he has certainly said things I would never say myself. None of that determines whether the government followed the law. I support strong borders. I support ICE enforcing valid removal orders. I support expecting people who come into this country legally to follow the conditions under which they were admitted. Milo does not deserve a celebrity exemption. If he received proper notice, knowingly failed to appear, overstayed his lawful status, and an immigration judge properly ordered him removed, then the government had an order to enforce. But there is another side of the rule of law that some people conveniently forget. The government has to follow the rules too. If three notices really came back marked “addressee unknown,” I want to know why the process continued using that address. But I also want to know whether Milo had fulfilled his own legal responsibility to update that address. Both facts matter. I want to know whether his attorney was actually counsel of record. I want to know whether that lawyer received notice. I want to know exactly what the government knew and when it knew it. That is not being soft on immigration. That is demanding competent government. Due process is not an obstacle to the rule of law. Due process is part of the rule of law. And then we have these supposed calls from Washington. I am not going to claim they prove political retaliation because we have nowhere near enough evidence to say that. But I'm also not going to pretend the allegation should be ignored simply because asking questions might make somebody uncomfortable politically. If they were routine calls, explain them. If Washington was simply following a high-profile immigration case, that may be the entire answer. If someone with political influence was pushing the government to accelerate or manipulate the process, then that would be a much more serious matter. Facts first. That same standard applies to Laura Loomer. Laura had every right to report Milo to ICE. If somebody believes another person is violating immigration law, they can notify authorities. But Laura making a phone call and Laura controlling the federal government are two completely different claims. Homan has now acknowledged she probably contacted ICE while insisting her involvement did not determine Milo’s legal fate. Until evidence shows otherwise, that distinction matters.

Milo Says ICE Knew Yiannopoulos says three of five immigration notices came back “addressee unknown,” his lawyer was bypassed, and ICE agents spoke of repeated “calls from Washington.” DHS and Tom Homan still maintain that he received due process and was lawfully removed. Milo Yiannopoulos is no longer merely saying his deportation was unfair. He is now making specific claims about what he says went wrong inside the immigration system. In a first-person account published by The Spectator, Milo claims immigration proceedings moved forward without his knowledge while notices were being sent to a Florida address he says he had left years earlier. More importantly, he says three of five warning letters were actually returned to the government marked **“addressee unknown.” He also claims federal records contained his attorney’s contact information even though, according to Milo, that attorney was not notified about the proceedings that eventually resulted in his removal. ([The Spectator][1]) Those are serious allegations. They are also still allegations. DHS continues to say Milo legally entered the United States in May 2019, remained beyond his authorized stay, failed to appear for his immigration hearing, and received a final removal order from an immigration judge on July 22 before ICE arrested and deported him to Britain. ([AP News][2]) That leaves us with a dispute that should ultimately be settled by records, not personalities. Three Returned Letters Could Change the Fight The most important new claim is not about Laura Loomer, Donald Trump, or Milo’s political enemies. It is about the mail. Milo says five immigration warning letters were sent and that three were returned marked “addressee unknown.” He says ICE agents themselves told him that while he was in custody. ([The Spectator][1]) If documentation backs that up, it could matter. Board of Immigration Appeals precedent recognizes that a person ordered removed in absentia can challenge that order on the basis that proper notice was not received. Immigration judges considering claims of nonreceipt can examine evidence surrounding delivery, including what address was used, how notice was mailed, prior immigration appearances, and other evidence bearing on whether the person actually received notice. ([Department of Justice][3]) That does not automatically mean Milo wins. Immigrants in removal proceedings also have responsibilities to keep immigration authorities informed of their current address. If the government sent notices to the legally required address because Milo failed to update it, that could substantially weaken his argument. That is why the immigration file now matters more than anybody’s X posts. What address did EOIR have? When was that address supplied? Did Milo properly update it? Were the notices actually returned? Was his lawyer formally entered as counsel of record? Was counsel served? Those questions can be answered. Milo makes another allegation that deserves scrutiny but not premature conclusions. He says agents transporting him toward his removal flight were receiving repeated “calls from Washington” and that some agents suggested his treatment was unusual. He also claims ICE repeatedly moved him among facilities, making it difficult for his lawyers to locate him, and that promises of a phone call, medical care, and a chance to appear before a judge never materialized. ([The Spectator][1]) That sounds dramatic. It does not yet prove political interference. A high-profile deportation could generate calls from Washington for perfectly ordinary reasons. DHS leadership could have been tracking the case. Officials could have been coordinating transportation. Reporters could have been asking questions. Or there could be something more. We simply do not know. And there is still no evidence tying those alleged Washington calls directly to Laura Loomer.

American citizenship should mean something, and it should never be marketed like a vacation package. The federal government should prosecute fraudulent operators, strengthen visa screening, secure the border, enforce E-Verify, and remove dangerous criminals who have no lawful right to remain. But enforcing immigration law and denying citizenship to someone already born in America are two different government powers. That is where the Fourteenth Amendment, the courts, Congress, and the constitutional separation of powers enter the debate. Supporting President Trump does not require abandoning limited government. A strong president should enforce the law aggressively while remaining disciplined enough to operate within the Constitution.
