Shaykh Abû ‘Alî al-Hasanî said: Those who issued verdicts on making up missed [obligatory fasts] from Ramadân during the 10 days of Dhul-Hijjah are: Abû Hurayrah, ibn al-Musayyib, Ibrâhîm an-Nakha’î, and Hammâd ibn Abî Sulaymân. These are narrated by Ibn Abî Shaybah in al-Musannaf and they are confirmed.

Shaykh Abû ‘Abdillâh al-Hâshimî was speaking about not cutting the hair and nails and said: This is only specific to the one who is slaughtering himself. So the people of his household are not included in it, nor the one who is appointed to do the slaughter on his behalf, nor those whom the slaughter is done for them by contribution, [by donation]. Rather this is only specific to each person doing the slaughter for himself. I asked the Shaykh: Is this agreed upon, or is there a difference of opinion amongst the Scholars of Fiqh? He said: I do not know of any difference of opinion about it, as it was not shown to me, but if you find it then send it to me Bârak Allâhu Fîk.

Shaykh Sulaymân al-‘Alwân was asked: What is the ruling on the one who intends to slaughter, then takes from his hair and cuts his nails? He answered: It is disliked to take anything from his hair or skin for the one who slaughters, due to the Hadîth of Umm Salamah that Prophet ﷺ said: “When the ten days (of Dhul-Hijjah) begin, and one of you wants to slaughter, let him not remove anything from his hair or skin.” Narrated by Muslim from the path of Sufyân, from ‘Abdur-Rahmân ibn Humayd, from Sa’îd ibn al-Musayyib, from Umm Salamah. And it has come with the wording: “Then you should not take from the hair or cut the nails.” And it’s narrated from the path of Mâlik ibn ‘Umar ibn Muslim, from Sa’îd, from Umm Salamah that the Prophet ﷺ said: “If you see the crescent of Dhul-Hijjah and one of you wants to slaughter, then he should not take from his hair and nails.” And its dislike was said by most of Ahlul-‘Ilm, and this is the Madh’hab of Mâlik, ash-Shâfi’î and Ahmad in a narration. And Abû Hanîfah said: “There is nothing [upon] the one who takes from his hair and nails.” Is’hâq [ibn Râhûyah] and Ahmad in a narration said: “It is Harâm.” Because the Prophet ﷺ prohibited that, and the basic principle concerning prohibitions is that it is forbidden. And the command has come by not taking [from the hair or nails] in his statement: “Then he should not take from his hair and nails.” And the basic principle in the command is that it is an obligation, unless there is an evidence [that makes the prohibition from being Harâm into being disliked]. But if someone takes from his hair without an excuse, before slaughtering, his slaughter is [still] sufficient according to consensus. And as for the one on whose behalf the sacrifice is done, and whoever slaughters on behalf of someone else by proxy or will, then it is not disliked for both of them to take from the hair and nails. And there is no dislike for the one slaughtering [for himself] to wash the hair, scratch it, or to remove a harmful substance from the fingernail and so on.

Shaykh Ahmad al-Khalîl said: Takbîrât in the 10 [days] are in 2 categories: the general and the restricted. The general: It is Takbîr at all times, from the first of the 10 until the last day of Tashrîq (13th of Dhul-Hijjah) and it is legislated according to the majority of the Fuqahâ’ and Salaf. The restricted: It is Takbîr after the [obligatory] prayers, from the Fajr prayer on the day of ‘Arafah (9th of Dhul-Hijjah) until ‘Asr on the last day of Tashrîq (13th of Dhul-Hijjah). And it is legislated by the agreement of the Fuqahâ’. It’s proof: It was said to [Imâm] Ahmad, by which Hadîth do you go to that Takbîr [is done] after Salât al-Fajr on the day of ‘Arafah until ‘Asr on the last day of Tashrîq? He said: By the consensus from ‘Umar, Alî, ibn ‘Abbâs, and ibn Mas’ûd.

Abû Dâwûd said that Ahmad ibn Hanbal said: I never answered a question except by the Hadîth of the Messenger of Allâh ﷺ if I found a way to that, or from the Sahâbah, or from the Tâbi’în. If I found it from the Messenger of Allâh ﷺ, I would never turn to [someone] else. But if I did not find it from the Messenger of Allâh ﷺ, then the four rightly guided Khulafâ’. If I did not find it from the Khulafâ’, then from the greatest of the companions of the Messenger of Allâh ﷺ, and then the greatest of those [who are after them in virtue] from the companions of the Messenger of Allâh ﷺ. If I did not find it [from them], then from the Tâbi’în and the followers of the Tâbi’în. A Hadîth never reached me from the Messenger of Allâh ﷺ about an action with a reward, except that I did it with hope of that reward, even if it was one time. [Al-Musawwadah]

The Hadîth: Whoever recites Sûratul-Qadr one time after his Wudû’, he is from the truthful, and whoever recites it two times, he is from the register of the martyrs, and whoever recites it three times, Allâh will gather him with the gathering of the Prophets.
