#CASE STUDY 2 🔸CHARTERED GURU🔸 🔸Case study Series🔸 👉Mr. X used to sell goods on credit to Mr. Y 👉Mr. Y accepted a bill of Rs.100,000 as security in favour of Mr. X 👉their understanding was that the bill will not be presented for payment unless and until Mr. Y fails to pay outstanding amount for goods bought from time to time 👉Mr. X owed an amount to Mr. Z which remained due for long period of time, Mr. X endorsed Mr. Y’s acceptance in favour of Z to meet his liability in favour of Mr. Z 👉Can Mr. Z demand payment of the bill from Mr. Y (assuming amount outstanding on account of goods bought by Mr. Y from Mr. X, at the time of maturity of the bill is only Rs.20,000)

#CASE STUDY 1 🔸CHARTERED GURU🔸 🔸Case study Series🔸 Mr. Ram is a resident of Navi Mumbai, Due to the spread of COVID 19, he decided to leave Mumbai and go back to his parental village near Indore, while leaving Mumbai he handed over keys of his house, and Scooter to his neighbour (Mr. Suresh), it was implied from their past relationship that Mr. Suresh can use Mr. Ram’s scooter for his day to day needs. Mr. Ram’s Car is also parked in his house but the keys of Car were not handed over to Mr. Suresh but kept by Ram with himself. While leaving Mr. Ram asked Mr. Suresh to take care of car as well. The scooter was being used my Mr. Suresh for day to day activities, on a particular day Mr. Suresh decided to go to Matheran (hill station 150 Km/s away from Mumbai). While going to Matheran the scooter met with an accident (due to fault in its clutch), it caused injuries to Mr. Suresh and also damage to the scooter. Mr. Ram had never informed Suresh about the clutch issue as he himself was also not aware about the clutch issue. Mr. Ram is intending to recover damages from Suresh for the loss caused to his scooter whereas Suresh is intending to recover damages from Ram for injuries caused to him due to faulty clutch.
