महाराष्ट्र नागरी सेवा (सेवेच्या सर्वसाधारण शर्ती) नियम, १९८१ { © Exam Guide Sagar} नियम २२ : धारणाधिकार कायम राहणे (Retention of Lien) हा नियम सांगतो की, जोपर्यंत कर्मचाऱ्याचा धारणाधिकार निलंबित (नियम २३) किंवा हस्तांतरित (नियम २६) होत नाही, तोपर्यंत तो खालील ५ परिस्थितींमध्ये आपल्या पदावरचा हक्क राखून ठेवतो: (a) कर्तव्यावर असताना: जेव्हा कर्मचारी स्वतःच्या पदावर प्रत्यक्ष काम करत असतो. (b) परकीय सेवा किंवा तात्पुरते काम: जर कर्मचारी 'फॉरेन सर्व्हिस'वर असेल, प्रतिनियुक्तीवर (Deputation) असेल किंवा दुसऱ्या एखाद्या पदावर 'प्रभारी/तात्पुरते' (Officiating) काम करत असेल. (c) बदलीचा मधला काळ (Joining Time): बदली झाल्यानंतर नवीन पदावर रुजू होईपर्यंतच्या काळात. (मात्र, कमी पगाराच्या पदावर कायमस्वरूपी बदली झाली असेल, तर कार्यमुक्त होताच हक्क नवीन पदावर जातो). (d) रजेच्या काळात: जेव्हा कर्मचारी कोणत्याही प्रकारच्या मंजूर रजेवर असतो. (e) निलंबनाखाली असताना: कर्मचारी निलंबित झाला तरी त्याचा त्या पदावरील हक्क (Lien) जात नाही. विशेष टीप (Note): जर एखादे पद तात्पुरते स्थगित (Abeyance) ठेवले असेल, तरी त्या पदावर कायम असलेल्या कर्मचाऱ्याचा धारणाधिकार संपत नाही. 🛑{ © Exam Guide Sagar}🛑 🛑 थोडक्यात 🛑 नियम २२ हा कर्मचाऱ्यासाठी एका 'विमा' (Insurance) सारखा आहे. तो खात्री देतो की तुम्ही रजेवर असाल, निलंबित असाल किंवा दुसऱ्या विभागात कामाला गेला असाल, तरी तुमची मूळ जागा तुमच्यासाठी सुरक्षित आहे. तुमची मूळ जागा तुमच्या परवानगीशिवाय किंवा तुम्ही दुसऱ्या ठिकाणी 'कायम' (Confirm) झाल्याशिवाय सरकार काढून घेऊ शकत नाही. 🛑{© Exam Guide Sagar} 🛑 @nmmc_assistant_commissioner Maharashtra Civil Services (General Conditions of Services) Rules, 1981 { © Exam Guide Sagar} Rule 22: Retention of Lien This rule states that, unless a Government servant's lien is suspended under Rule 23 or transferred under Rule 26, he/she retains a lien on their post in the following five circumstances: (a) While performing duties: When the employee is physically working on their own post. (b) Foreign Service or Officiating: If the employee is on 'Foreign Service', on Deputation, or is 'Officiating' (temporary charge) in another post. (c) Joining Time during transfer: During the period between leaving the old post and joining the new post. (However, if the transfer is to a lower-pay post on a substantive basis, the lien is transferred to the new post from the date the employee is relieved from the old post). (d) During Leave: When the employee is on any kind of sanctioned/granted leave. (e) Under Suspension: Even if an employee is suspended, their lien (legal right) on that post is not terminated. Special Note: If a permanent post is subsequently held in 'Abeyance' (kept vacant temporarily because it is not required for active duty), the employee confirmed in that post continues to hold a lien on it during that period. 🛑{ © Exam Guide Sagar}🛑 🛑 In Short 🛑 Rule 22 acts like 'Insurance' for the employee. It ensures that whether you are on leave, suspended, or working in another department, your original position remains secure for you.
