The Supreme Court has kept in abeyance (stayed) its November 20, 2025 judgment that had accepted a new, elevation‑based definition of “Aravalli Hills” and “Aravalli Ranges” and linked mining permissions to that definition. A fresh, high‑powered expert committee is now proposed to re‑examine the scientific basis and ecological implications of that definition before any implementation.[1][2][3][4]
## What the Court Has Done
- The Bench of Chief Justice of India Surya Kant, and Justices JK Maheshwari and AG Masih has ordered that both the earlier expert committee’s recommendations and the Court’s own directions in the 20 November 2025 judgment will remain in abeyance in a suo motu case titled “In Re: Definition of Aravalli Hills and Ranges and Ancillary Issues”, SMW(C) No. 10/2025.[4][1]
- Notice has been issued, returnable on 21 January, and the Attorney General for India and Senior Advocate P.S. Narasimha (referred to in some reports as PS Parmeswar) have been requested to assist, including on the composition of the proposed expert committee.[3][1]
## Why the Stay Was Granted
- The Court has expressed concern that the earlier expert committee report and the November 20 directions were being misconstrued or misinterpreted, particularly in a way that could open the door to unregulated mining and ecological harm.[5][1]
- Specific doubts flagged include: whether treating only landforms with at least 100 metres elevation as “Aravalli Hills” leaves out a large number of ecologically linked features; whether the 500‑metre proximity rule for constituting an “Aravalli Range” creates a “structural paradox” by narrowing conservation areas; and whether mining could be permitted in 500‑metre gaps between hills without breaking ecological continuity.[1][3]
## Background: The November 20 Judgment
- On 20 November 2025, the Supreme Court in an earlier bench had accepted the Union‑backed operational definition that:
- “Aravalli Hill” means any landform in designated Aravalli districts with minimum elevation of 100 metres from local relief, including supporting slopes and connected landforms; and
- “Aravalli Range” exists where two or more such hills lie within 500 metres of each other.[2][1]
- That judgment also directed the Union Government (MoEF&CC) to prepare a Management Plan for Sustainable Mining (MPSM) for the entire Aravalli region, and imposed an interim bar on new mining leases until the MPSM was prepared, while permitting only sustainable, regulated mining outside core/inviolate areas.[6][7]
## Ecological and Regulatory Concerns
- Environmental groups and civil society had protested that the 100‑metre elevation threshold and 500‑metre clustering rule could exclude many ecologically important ridges, spurs and low‑height landforms that together maintain groundwater recharge and act as a barrier against desertification.[8][1]
- The Court has now specifically asked whether the claim that only 1,048 out of 12,081 hills meet the 100‑metre threshold is factually and scientifically accurate and whether a fresh geological and ecological inquiry is required before any such definition is used for regulatory purposes.[9][1]
## Immediate Practical Position
- Till the new expert committee is constituted and reports back, the November 20 definition and directions, along with the earlier committee’s recommendations, are not to be implemented.[4][1]
- The Solicitor General has informed the Court that notices have been issued to the concerned States directing that no further mining activity be carried out, which, in practice, means heightened restraint on new mining operations in the Aravalli belt pending further orders.[9][1] | 224 |
