“A New York state Supreme Court ordered all New York City employees who were fired for not being vaccinated to be reinstated with back pay. The court found Monday that "being vaccinated does not prevent an individual from contracting or transmitting COVID-19." SLO Public Health Director’s Indefinite Order Recently we learned from our regional group, Central Coast Health Coalition, that San Luis Obispo County's Public Health Director, Dr. Penny Borenstein, signed an order that requires healthcare workers be up to date on Covid-19 and Flu vax each year, else they must wear a mask throughout the entire flu season, which lasts from November 1 - April 30. The order applies not only to workers in hospital or high-risk settings, but also to chiropractors, acupuncturists, and other healthcare workers in preventative or alternative healthcare models. CHCA encourages you to TAKE ACTION to help stop these mandates: 1) sign the petition: https://www.change.org/p/sign-the-petition-no-vaccine-mandate-on-our-slo-county-health-care-workers, 2) email the SLO County Board of Supervisors before October 17th at [email protected] expressing your opposition to this order, and 3) let us know if your county’s public health director has put out similar orders.

$9,780 Left to Go to Reach our Summer Fundraising Goal Invest in health freedom and keep CHCA advocating at the capitol. We keep a very low overhead, spend prudently, and have no paid staff. Our board members volunteer countless hours to handle the work needed on all our projects. Over the next six months, our budget needs are primarily for our lobbyist who champions relationship building in-person at the Capitol on our behalf. He handles legislative logistics: scheduling and hosting meetings, submitting letters, tracking bill status, testifying and offering public comment in person, and building our coalition of support for health freedom. On July 4, 2023, health freedom and free speech in the United States had a huge win through a court order in the case of Missouri versus Biden. The federal judge ordered the Biden administration to end government directed and encouraged censorship on social media. We all saw (and still see) how certain voices and messages were suppressed on social media platforms throughout the pandemic. The plaintiffs (State of Missouri, State of Louisiana, Dr. Kheriaty, Dr. Kulldorff, Jim Hoft, Dr. Bhattacharya, & Jill Hines) came together to push back on the violation of the 1st Amendment rights. The ruling states, "The Plaintiffs are likely to succeed on the merits in establishing that the Government has used its power to silence the opposition. Opposition to COVID-19 vaccines; opposition to COVID-19 masking and lockdowns; opposition to the lab-leak theory of COVID-19; opposition to the validity of the 2020 election; opposition to President Biden’s policies…” The Biden Admin appealed the ban on social media contacts.

AB 2098 (COVID-19 Disinformation Bill) Lawsuits Update Last year, Governor Newsom signed AB 2098 into law. The bill designated “the dissemination or promotion of misinformation or disinformation related to the SARS-CoV-2 coronavirus, or “COVID-19,” by a physician or surgeon as unprofessional conduct, allowing the Medical Board to take action against such physician or surgeon.” Immediately lawsuits were filed. This week, oral arguments were heard in the 9th Circuit Court of Appeals in two cases challenging AB 2098. Attorney Laura Powell tweeted about the hearings with video highlights. She writes: “Judge Forrest points out that there has been a great deal of disagreement in the medical community about Covid, and therefore, passing a law that requires doctors to conform to some idea of medical consensus “seems odd.”” We will be watching and sharing updates on these cases in future emails.
