Case: Biswajyoti Chatterjee v. State of West Bengal & Anr., Criminal Appeal No. 1842 of 2025, 2025 INSC 458 .
Key Quote: "Every consensual relationship, where a possibility of marriage may exist, cannot be given a colour of a false pretext to marry, in the event of a fall out. It is such lis that amounts to an abuse of process of law."
Significance: The judgment reinforces that only a promise made in bad faith with no intention to marry at the time it is given can vitiate consent under rape law. A genuine promise that is broken later does not retrospectively criminalize consensual intimacy. The Court cautioned against the "growing tendency" of using criminal proceedings to settle failed relationships.
Result: Appeal allowed. Proceedings terminated. No order as to costs.

A six-year #consensual relationship with #cohabitation and #mutual visits;
The Court held that the allegations in the FIR, even if accepted entirely, did not prima facie constitute rape because the relationship was demonstrably consensual over a prolonged period, and there was no allegation of a false promise from the outset. The SC/ST Act charges also failed because the pre-amendment law did not cover private digital insults. The FIR was quashed.
