पटना हाईकोर्ट ने ऐसे ही एक मामले में अहम टिप्पणी करते हुए कहा कि केवल किसी जीवनसाथी को आपत्तिजनक स्थिति में देख लेना, अपने-आप में व्यभिचार साबित करने के लिए पर्याप्त नहीं है।
कोर्ट ने स्पष्ट किया कि ‘आपत्तिजनक स्थिति’ में होना और किसी दूसरे व्यक्ति के साथ शारीरिक संबंध बनाना, दोनों अलग बातें हैं। व्यभिचार के आरोप को साबित करने के लिए ठोस और कानूनी रूप से मान्य सबूत जरूरी हैं।
