First, Zelenko Labs sued Foster Coulson and The Wellness Company, alleging breach of fiduciary duty, misappropriation of trade secrets, concealed transfers, fictitious invoices, diversion of assets, formulas, employees and resources, and claiming TWC was built using the Zelenko enterprise while its rightful owners were kept in the dark.
Now a second lawsuit has landed, and the allegations are even more explosive.
Center City Pharmacy has filed a 98 page federal complaint accusing Foster Coulson, Peter Gillooly, The Wellness Group and their associates of participating in an alleged racketeering and prescription diversion enterprise involving:
β’ A pharmacy allegedly sold once, then sold again β’ More than 5,800 prescriptions allegedly diverted β’ Patient records and proprietary formulas allegedly transferred β’ Bank accounts, credit and regulatory credentials allegedly misused β’ Electronic records allegedly deleted β’ Medications allegedly shipped across state lines under another pharmacyβs identity β’ A public claim that TWC had acquired a β50 state pharmacy platformβ the lawful owner says TWC never owned
The complaint alleges The Wellness Group publicly rebranded βCity Center Pharmacyβ as ScriptfulRX even though the actual Center City Pharmacy had already been sold, and no Florida pharmacy by the transposed name even existed.
One lawsuit alleges the Zelenko legacy was stripped for parts.
The next alleges a pharmacyβs identity, patients, prescriptions, licenses and operating history were commandeered and monetized.
Same company.
Same central figure.
Same alleged pattern of taking control, moving assets, rewriting ownership and profiting from what belonged to someone else.
These are allegations, and the defendants are entitled to respond in court. But this is no longer something that can be dismissed as one disgruntled former partner or one isolated business dispute.
How many lawsuits does it take before regulators, investors, customers and law enforcement start asking what exactly Foster Coulson and The Wellness Company have been building, and whose property they allegedly used to build it? | 2 040 |
