(2007/2008 G.C.) to address long-standing court delays, accumulation of criminal cases, and inefficient resource utilization in Ethiopia, still faces numerous legal and implementation challenges. The study was conducted by the FDRE Law and Justice Institute. According to the study, the process not only lacks a clear and consistent legal framework but also shows significant differences in interpretation between federal and regional courts. This study, conducted by a team of legal researchers, focused on courts in Federal (Addis Ababa), Amhara (Bahir Dar), and Oromia (Adama) regions, and was presented after examining a sample of 712 cases that received decisions under the accelerated criminal justice process in 2017 E.C. (2024/2025 G.C.). The accelerated criminal justice process has shown positive experience in expediting justice. Out of the 712 cases reviewed, 53.1 percent (378 cases) received a final decision within 30 days of the defendant's appearance, and a total of 66.9 percent (476 cases) were completed within two months. The study compared practices in countries like France and Germany, detailing the gaps in Ethiopia's system regarding defendants' rights and the quality of justice. Among the study's findings, the handling of defendants' rights in the process was presented as a major concern. Out of the 712 cases reviewed, 235 (33 percent) resulted in sentences of 1-3 years imprisonment, while 67 (9.3%) received sentences of over three years. Among the 67 cases, 11 received severe sentences of 6 to 12 years imprisonment. Ten percent of the 712 cases reviewed took more than a year to reach a decision due to incomplete witnesses, case complexity, defendants absconding on bail, and extended adjournments, making the process resemble a regular criminal justice process rather than an accelerated one. The study stated that although the accelerated criminal justice process was primarily intended to handle minor offenses, in practice, serious crimes such as homicide, rape, and grievous bodily harm have also been observed being tried under this process. Due to a lack of clear guidelines, offenders under 15 years old and minors under 18, as well as individuals with mental illness, have been brought before the accelerated criminal justice process. As the types of crimes handled by this process are not clearly defined, many cases with multiple defendants and overlapping charges are being heard simply because there is complete evidence. Although informants stated that the accelerated criminal justice process is implemented when defendants and witnesses are complete, in practice, it has been observed to proceed with incomplete defendants and witnesses. Furthermore, the study indicated that the lack of sufficient interpreters in courtrooms during the accelerated criminal justice process restricts defendants' rights to understand the charges in their language, enter a plea, and present an adequate defense.
