| 16 | Tobias Otieno (also known as Tobias Ochieng) was a 42-year-old Kenyan national who built a stable career as a municipal auditor in the United States.
Otieno moved from Kenya to the United States in 2017, where he was hired by the New York State Office of the State Comptroller in 2018 as a municipal auditor ("Auditor 1"). His position as a state auditor paid an annual salary of approximately $75,000 (approx. 9.8 million Kenyan shillings).
Between 2019 and 2023, Otieno was trusted to review the financial operations, payrolls, and procurements of numerous public institutions across New York.
On August 18, 2026, a 42-year-old Kenyan man, Tobias Otieno, former New York State auditor, was sentenced to 4 to 12 years in state prison for using his public office to steal $405,843.25 from the Town of Wallkill.
According to court documents, between June 2022 and September 2024, while working as an Auditor 1 for the New York State Office of the State Comptroller, Otieno used his authorized access to transfer town money directly into his personal business accounts when he was assigned to audit Wallkill's municipal finances.
As a State Auditor 1, his job was to act as a financial watchdog for the public. His assignment required analyzing Wallkill's internal payroll, procurements, and non-payroll disbursements. The town granted him direct administrative access to their municipal bank accounts and internal financial software to conduct the review. His job was to make sure taxpayer money was being spent legally and to look for signs of waste or fraud.
To do this deep financial check, the town had to trust him completely. They gave him top-level administrative usernames and passwords. This let him look into their internal accounting software and real-time bank accounts.
Instead of protecting the town's money, Otieno used his special access to steal it. He created a network of fake businesses, shell companies, and hooked up his personal bank accounts to these fake companies.
While logged into Wallkill's financial system as an authorized auditor, he secretly set up electronic wire transfers. He transferred the town's cash directly into his fake business accounts, and hoped the transfers would look like normal, boring business payments to outside vendors.
While employed by the New York State Comptroller’s Office to review municipal finances, Otieno exploited his administrative access to siphon $405,843 (approx. KSh 52 million) directly out of the municipal bank accounts of the Town of Wallkill in Orange County.
The plan fell apart when the town looked at their bank statements, and realized that the total amount of money they actually had did not match what their records said they should have. Money was missing.
Town officials looked closer and found wire transfers that had no receipts, no invoices, and no approvals from management. Forensic investigators stepped in and traced the computer logs. Every computer leaves a digital footprint. The logs showed that the person who approved those weird transfers used the exact administrative credentials given to Otieno.
When investigators tracked where the money landed, they realized it went straight from Wallkill's accounts into the fake business accounts controlled by Otieno, linking him directly to the crime.
Security logs showed that these wire transfers were authorized using administrative system credentials, yet the recipient bank accounts belonged to private commercial entities rather than verified municipal vendors.
