Response to the Audit Finding It is recalled that the Federal Auditor General disclosed significant audit findings on the Welmel and Chelchel irrigation projects. After this report was released, the Ministry of Irrigation and Lowland Areas issued a statement, though it did not directly name the Office of the Auditor General. The main contractor, Alemayehu Ketema General Contractor, directly responded to the report. In its statement, without directly naming the Federal Auditor General, the Ministry stated that efforts to obstruct and tarnish the achievements recorded in the irrigation sector are unacceptable. It mentioned that historically unprecedented results are being achieved in Ethiopia's irrigation sector, indicating the existence of forces that do not want to accept and criticize this success. Six homebuyers have taken Noah Real Estate to the Federal High Court, stating, "We have handed over our apartments for which we paid over 50 million Birr." The buyers filed the lawsuit concerning the 19-story Noah Victory Site located in the Yeka Sub-city, Woreda 6, Women's Square area of Addis Ababa. According to the plaintiffs, the developer, Noah Real Estate, had contractually agreed to complete construction and hand over the apartments within 36 months, but in practice, it took six years. The plaintiffs state that Noah Real Estate had agreed in the contract to complete and hand over the apartment residential units within three years from the contract date, but "during this time, the defendant was unable to complete and hand over the apartment to the plaintiffs." They mentioned that the construction was completed three months ago this year, and even after a long delay, Noah Real Estate is unwilling to hand over the apartments to the plaintiffs as per the contract. For this reason, they stated in their lawsuit that they were forced to go to court after giving a written warning on March 30, 2018 E.C., but received no positive response. Noah Real Estate, for its part, stated that the plaintiffs have not paid the square meter difference that arose when individual maps were prepared. The lawsuit document further explains that other plaintiffs similarly completed their payments in full, specifying the area of their homes, common areas, and circulation areas. In its response to the court, Noah Real Estate admitted that the plaintiffs had made their payments and that construction was completed, but cited that an increase of more than 10 percent in square footage was observed when individual maps were prepared. National Dialogue #Day4 The Ethiopian Political Parties Joint Council told Tikvah Ethiopia that three political parties, which had not participated in the national dialogue, finally joined the national conference at the last minute. Previously, some political parties had remained outside the dialogue, demanding that various preconditions be met. According to Ato Solomon Ayele, Chairman of the Council, "Wolaita National Movement (WBN), Arena Tigray, and Enat Party participated in the conference being held at the Convention Center; there are still 5 or 6 parties that have not participated; we have called on them to participate." The case that has been litigated for over 2 years between Flintstones S.C. and its customers has reached a conclusion at the Federal Cassation Court. According to the ruling, Flintstones Share Company will pay over 282 million Birr in compensation to its former customers. The Federal Supreme Court Cassation Bench, in its session held on 08/11/18 E.C., upheld the decision previously given by the Arbitration Tribunal regarding 212 customers who filed a lawsuit against "Flintstones Engineering S.C." (currently named Flintstones S.C.) for purchasing homes from the company but not receiving construction handover. The case began because Flintstones Engineering S.C. failed to hand over homes within the agreed-upon time, according to home purchase contracts entered into with its customers from 2008 to 2009 E.C. The customers had purchased homes through a contractual agreement with Flintstones Homes S.C., a real estate company engaged in building and selling houses, for the construction and handover of condominium buildings at a site called "Bole Beshale" in Lemi Kura sub-city, Addis Ababa. According to the contract, the home handover should have been completed within 28+2 months from the year the customers made the purchase; however, due to repeated delays in construction by the company, the customers did not receive handover for many years. Although the plaintiff customers made the home purchases at various times between 2008 E.C. and 2009 E.C., Flintstones failed to build and hand over the homes within the contract period specified in their home construction and sale agreements. Following this, 212 plaintiffs (homebuyers) jointly took the matter to an Arbitration Tribunal and filed a lawsuit. The Arbitration Tribunal, after hearing evidence and arguments from both parties, issued a detailed ruling on May 23, 2016 E.C. In its decision, the Tribunal confirmed that the customers have the right to compensation for the damages they incurred because the company failed to adhere to the contractual construction completion deadlines (i.e., 15 months for foundation work, additional months for second-stage construction, and final handover time, all calculated from the contract signing date). At the Tribunal, Flintstones Share Company argued that it could not build and hand over the construction as per the contract due to the COVID-19 pandemic, the civil war in the north, the depreciation of the Birr's purchasing power, foreign currency shortages, and other related reasons, but these arguments were not accepted by the Tribunal.
