New Criminal Laws: Safeguarding Rights & Strengthening Justice
Bharatiya Nyaya Sanhita, 2023, Bharatiya Nagarik Suraksha Sanhita, 2023, and Bharatiya Sakshya Adhiniyam, 2023; the new criminal laws have come into effect
Get an insight into the new Criminal laws transforming legal framework within the country:
➤ Police cannot detain without explanation for more than 24 hours
➤15 days Police Remand can be taken in whole or part over the first 40/60 days of the 60/90-day detention period
➤Police now have discretion to handcuff arrested persons during arrest or court production, subjecting only habitual and heinous offenders to it
➤Trial in absentia is a formidable provision introduced to expedite case disposal. Proper safeguards are in place to protect the rights of the accused
➤Trial in absentia aims to compel the proclaimed offender to join the proceedings. If they choose not to, the trial will proceed, and judgment will be pronounced in their absence
