Basically, the Rule Against Perpetuities means, for private trusts, that the trust must end (vest) within a certain timeframe. It cannot go on forever. For private trusts, the beneficial interest (benefits) must be vested in the beneficiaries no later than 21 years after the death of the grantor. The beneficiaries must be definitely ascertained, or will be within a certain timeframe. For instance, you cannot have as a beneficiary your great-great-great-great-grandchild, who might not be born for over 100 years after your (the grantor's) death, if they are born at all.The Rule Against Perpetuities does not apply to public or charitable (those adjectives are synonymous for trusts) trusts...that's because for charitable trusts, the beneficiaries are of  "an uncertain and fluctuating" character, so these trusts have a "permanent and indefinite" character. Bottom Line: when you write your trust, make sure that the trust indenture (your laws for the trust) gives a definite time to end, or else your trust will fail!
