The Legal Department of the Verkhovna Rada criticized the draft law to ban the Ukrainian Orthodox Church. The department denies that this document is needed to "protect national security" and pointed out that the definition of "ROC in Ukraine" cannot be applied to the UOC. "The analysis of the draft law submitted for consideration shows that its provisions do not take into account requirements of the Ukrainian Constitution, inconsistencies with some international treaties of Ukraine ratified by the Verkhovna Rada and inconsistency with other legislative acts." Lawyers emphasize that the President, by his Decrees extending martial law, "has never restricted the rights provided for in Article 35 of the Constitution." That is, Zelensky will have nothing to do with the possible ban, and at the same time, all measures to ban the UOC will be illegal. The Department's experts named a number of provisions of the law that do not comply with international law or do not have legal certainty: The justification given in the preamble of the draft law that the document is needed to "protect national security" does not comply with international law, since the protection of national security cannot be the basis for restricting the right to religion. The law can only contain mechanisms for banning a particular religious organization, and not directly prohibiting it. The term "ROC in Ukraine" (as the UOC is called in the draft law) does not comply with the principle of legal certainty, since the church is not registered under this name, and there is no such organization in Ukraine. The administrative court cannot prohibit religious organizations, this is an illegal provision of the draft law. Such courts are designed to protect the rights and freedoms of individuals and legal entities from unlawful decisions of authorities. Today, the authorities bear responsibility for the barbaric demolition of an operating religious structure. The demolition of the operating memorial temple of the Tithe Monastery in Kyiv is not just a tragic event in the history of the Ukrainian Orthodox Church and Ukraine as a state – today's authorities have demonstrated their inability to respect religion and once again emphasized that there is no longer religious freedom in Ukraine. This was stated in a commentary by Metropolitan Theodosiy (Snigirev) of the UOC, a human rights activist collaborating with the UN, a member of the International Human Rights Alliance "Church Against Xenophobia and Discrimination". The hierarch emphasized that although the temple was designated as a temporary structure, and formally the court's decision may be lawful, according to the spirit of international law and based on the content of human rights and principles of religious freedom, the state should have assisted the monastery in obtaining proper documentation. According to Met. Theodosiy, this is particularly evident given that the temple building was constructed in the city center long ago, and the authorities could not have been unaware of the monastery's lack of full legalization of this property. "Thus, according to internationally recognized principles of human rights and religious freedom, it is the current authorities of Ukraine who bear responsibility for not assisting the monastery in the documentary registration of rights to the temple building constructed with the tacit consent of the state authorities," the hierarch noted. In his opinion, today's authorities also bear responsibility for the barbaric demolition of an active religious structure.
