Unfortunately, because this sits under the high standard of proof required by criminal law, prosecutors must prove malicious intent beyond a reasonable doubt to secure prison time. This creates a highly controversial loophole where a mother could avoid jail by claiming she “honestly didn’t know” there was an overlapping conception window, which is just ignoring the biological reality that she is the ONLY person who could know a possibility existed and chose to omit it. Crucially, however, the mother’s claim of ignorance is only a shield against prison, not against financial restitution. Based strictly on biological reality rather than intent, a negative court-ordered DNA test triggers the automatic, immediate cancellation of the man’s legal paternity and future support liabilities. Law 535 then establishes an explicit legal path for the defrauded man to recoup his losses, permitting civil lawsuits for full retroactive child support repayment against either the actual biological father (which I don’t think is the best idea) or the mother for damages.
