Seems this is showing that the Association of American Physicians and Surgeons published a guideline to doctors and patients that includes antivirals, etc....and MANY hospitals are not following this...prompting legal action. Two potential Covid-related tort claims: Med-mal/wrongful death; and Negligent Infliction of Emotional Distress. Potential for Covid med mal and/or wrongful death claim: The negligent (and perhaps willful) failure of medical providers to provide early treatment to symptomatic Covid patients, leading to increased illness, disability, unnecessary hospitalization, long haul covid, and/or death. Potential NEID Claim in the Covid and Racial Context Triggered by provider’s failure to deploy the Covid early treatment standard of care, to the detriment of the patient, and as witnessed by a spouse, loved one, family, friend, or anyone in close proximity who suffers emotional or physical harm as a result. Super interesting in Lancet. 69 fully vaxed healthcare workers in infectious disease hospital in Vietnam tested positive ONLY 7-8 weeks after 2nd dose. There were already breakthroughs at 7-8 weeks! All Delta variant. Their vaxed viral loads were 251x what had been previously seen with COVID last year. Took them 8-33 days to test negative. Breakthrough Delta variant infections are associated with high viral loads, prolonged PCR positivity, and low levels of vaccine-induced neutralizing antibodies, explaining the transmission between the vaccinated people.
