1. Ban on Governance from Jail
• No Prime Minister, Chief Minister, or Minister (Union/State) can govern while in custody.
2. Constitutional Gap
• Framers didn’t imagine leaders would refuse to resign after arrest.
• Recent trend: some CMs/Ministers running governments from jail without stepping down.
3. 30-Day Bail Window
• Accused politician must secure bail within 30 days of arrest.
• If not → automatic disqualification from position on Day 31.
• PM (Centre) or CM (States) obliged to remove them.
• If bail granted later → can resume office.
