https://www.livelaw.in/top-stories/supreme-court-adr-petition-against-section-16-cec-act-immunity-of-election-commissioners-notice-issued-554456
• The Election Commission and the Central Government have been asked to respond to a petition challenging the lifetime immunity from criminal prosecution granted to current and former Chief Election Commissioners (CECs) and other Election Commissioners by the Supreme Court.
• The CEC Act 2023, under Section 16, provides both former and serving CECs and Election Commissioners with blanket immunity from criminal prosecution for life.
• This lifetime blanket immunity is not even granted to the President, Governors, and Judges. Section 16 was not part of the CEC bill when it was introduced, but it was added later.
• Kudos to the Association for Democratic Reforms (ADR) for challenging this blanket immunity provision. Section 16 has placed the Election Commissioners in a position of extraordinary legal protection.
