Two decisions issued today by the U.S. Court of Appeals for the Fifth Circuit could spell the end of these unconstitutional requirements—with potentially huge consequences for the future of free speech. The Fifth Circuit reversed a lower court’s dismissal of the Goldwater Institute’s First Amendment challenge to Louisiana’s requirement that attorneys join the Louisiana State Bar Association (LSBA) as a condition of practicing law.
