Article 15: The Oireachtas may only make laws “in accordance with the Constitution.” The Oireachtas is not above the Constitution. But in practice, the Oireachtas is below the EU legal order This is the reality created by: The Treaties The ECJ supremacy doctrine Article 29.4 (EU membership clause) The ECJ has long held that: EU law has supremacy over all national law, including national constitutions. This isn’t theory. This is the foundational structure of the EU legal system. In fact, the ECJ has ruled repeatedly: EU law cannot be overridden by constitutional rights EU law cannot be undone by national parliaments EU law must be applied by courts even against the national constitution Only withdrawal from the Treaties can undo EU supremacy Which means: The Oireachtas is beneath the EU legal system. It is not autonomous. It is not sovereign in any area covered by the Treaties. The Hierarchy in Ireland TODAY looks like this: Top: EU Constitution / Treaties (via ECJ supremacy) Irish Constitution (subordinated where Treaties apply) Oireachtas (must implement EU law) Irish legislation That’s the real pyramid. The Oireachtas is not the top law-maker in Ireland. It is bound by: EU directives EU regulations ECJ case law EU fundamental rights law EU digital, migration, climate, and data frameworks In any of these areas, the Oireachtas cannot legislate freely. It can only legislate inside the boundaries set by the EU. That is why the Irish Constitution is being bypassed. Because the Oireachtas: must comply with EU supremacy, must transpose EU directives, must harmonise Irish law with EU law, and cannot contradict the ECJ. So when someone says: “The Oireachtas is a law unto itself.” The deeper truth is: It acts independently of the Irish people, but not independently of the EU. It is constrained upwards by Brussels, not by Ériú.
