📓In recent months, Kazakhstan’s digital legislation has undergone a comprehensive overhaul. The January enactment of the Law of the Republic of Kazakhstan ‘On Artificial Intelligence’ (the ‘AI Law’), amendments to the Law of the Republic of Kazakhstan ‘On Personal Data and Its Protection’ (the ‘Personal Data Law’), and the extensive codification of the sector through the Digital Code of the Republic of Kazakhstan have fundamentally changed the regulatory landscape.  An analysis of the new regulatory framework has revealed systemic inconsistencies in certain provisions. 🇷🇸Partner and attorney-at-law Stevan Pajović, representing T-S Legal in association with GRATA International, participated as a speaker at this year's Internet Dialogue Conference, organized by the University of Belgrade Faculty of Law and the Chamber of Commerce and Industry of Serbia.  Stevan took part in the panel discussion titled "Streaming Services: Under the Lens of Copyright and Related Rights", where he joined fellow legal and industry experts in discussing key challenges of the digital market. The panel focused on the concept of streaming and technological developments, various business models in the industry, and different forms of exercising the right of making content available to the public through OTT platforms. Other panel participants included Prof. Dr. Slobodan Marković, Srđan Mitrić (SOKOJ), Marijana Vukasinović (Telekom Srbija), and Christophe Van Vaerenbergh (PlayRight), who joined remotely. The discussion was moderated by Assistant Professor Dr. Novak Vujičić.

📖Настоящая статья посвящена недавней практике казахстанских налоговых органов в части налогообложения облачных сервисов. В 2024 году иностранная и казахстанская компании подписали договор на оказание услуг. Согласно данному договору, иностранная компания предоставила казахстанской компании услуги по предоставлению доступа к облачной инфраструктуре и вычислительным ресурсам. При этом, в договоре на оказание услуг было указано, что иностранная компания предоставляет бесплатную лицензию казахстанской компании исключительно в целях использования услуг иностранной компании. Цель предоставления такой лицензии была обусловлена тем, что доступ к облачной инфраструктуре и вычислительным ресурсам, помимо прочего, предполагает взаимодействие с интеллектуальной собственностью иностранной компании. Следовательно, для юридической возможности использования услуг иностранной компании, ей необходимо было предоставить соответствующие права казахстанской компании. 🔗Читать полную статью

📖This article is dedicated to recent practice of the Kazakh tax authorities regarding the taxation of cloud services. In 2024, a foreign company and a Kazakhstani company entered into a service agreement. Under this agreement, the foreign company provided the Kazakhstani company with access to cloud infrastructure and computing resources. At the same time, the service agreement stated that the foreign company granted a free license to the Kazakhstani company solely for the purpose of using the foreign company’s services. The purpose of providing such a license was due to the fact that access to cloud infrastructure and computing resources, among other things, involves interaction with the foreign company’s intellectual property. Therefore, in order to legally enable the use of the foreign company’s services, it was necessary to grant the Kazakhstani company the corresponding rights. 🔗Read the full article
