It is very much about the teacher. Not all teachers are built the same. Ibn Abi 'l-Awwam reports in his book: كان رجل يختلف إلى زهير بن معاوية ثم فقده، فأتاه بعد ذلك فقال: أين كنت؟ قال: ذهبت إلى أبي حنيفة، قال: نعما فعلت، لمجلس تجلسه مع أبي حنيفة خير لك من أن تأتيني شهراً A man used to attend the lessons of Zuhayr ibn Mu'awiyah. [Zuhayr] then did not find [for some lessons]. [When the met again, Zuhayr] asked, 'Where have you been?' He said, 'I went to Abu Hanifah.' He said, 'You have done well. One sitting you attend with Abu Hanifah is better for you than coming to me for a month.' So it is as much about the teacher as it is about the curriculum set up and a student's drive.

On this issue, the Pakistani Deobandis are fully “Barelwified”. In fact, they are so “Barelwified” that they are now in a double bind: they on the one hand want to support these laws, and in the other hand want to be seen as the defenders of their akabir that would have been a target of such allegations.

As far as train wrecks go, this is a pretty bad one. Mufti Tariq Masood here offers up the usual tit for tat polemical serving that might go down well in some Pakistani religious circles, but in reality looks quite farcical to everybody else. Apart from the last 60 seconds, it was the usual “you are as bad as we are” message targeted at Barelwis. And it was riddled with scholarly errors. He really is way out of his depth. As for the last 60 seconds, which should have quite frankly been the main focus and the bulk of his ‘save my skin’ clarification in this video, then that was yet another masterclass in gaslighting on his part. He suggests that the allegations of hypocrisy levelled against him emanate from secularists and liberals, which in itself is patently false. Nor does he adequately answer those allegations of hypocrisy - how he and his ilk have been happy to see others ripped from the face of the earth over false allegations of gustakhi but he’s buying his time in Canada until he’s in the clear. Not only that, he should look around him and see how many Mullahs in his own circles uphold due process and respect the court of law. After all, they still refer to Asiya Bibi as Asiya the Accursed (ملعونہ) in spite of the Supreme Court’s verdict. In those days, Tariq Masood himself tried to jump on the bandwagon by giving emotional solace to the street urchins of Pakistan - in his speech that has now gone down in infamy - that their homocidal feelings were justified because the Supreme Court did not offer a sufficient explanation and was too hasty in its judgement to acquit Asiya. Not only was that a disrespect of the Supreme Court, it was also a profound ignorance of his own Hanafi School of law that is quite happy to acquit. Now that the chickens have come home to roost for Tariq Masood who served up Khadim Rizvi as some devoted servant of the religion, people should not hold themselves hostage to siding with either the anti-intellectual shenanigans of TM or the homicidal instincts of Brillo nutcases. https://youtu.be/gUKjXmBGM7E

Translation of Tafsir Ibn Kathir on the Prophet condemning the behaviour of the Israelite elites: This woman was from the tribe of Makhzum. Her story was narrated in the Two Sahihs from Az-Zuhri from `Urwah from `A'ishah, The incident caused concern for the Quraysh after she committed the theft during the time of the battle of the Conquest of Makkah. They said, "Who can talk to Allah's Messenger about her matter'' They then said, "Who dares speak to him about such matters other than Usamah bin Zayd, his loved one.'' When the woman was brought to the Messenger of Allah, Usamah bin Zayd talked to him about her and the face of the Messenger changed color (because of anger) and he said, «أَتَشْفَعُ فِي حَدَ مِنْ حُدُودِ اللهِ عَزَّ وَجَلَّ؟» (Do you intercede in a punishment prescribed by Allah) Usamah said to him, "Ask Allah to forgive me, O Allah's Messenger!'' During that night, the Messenger of Allah stood up and gave a speech and praised Allah as He deserves to be praised. He then said, «أَمَّا بَعْدُ فَإِنَّمَا أَهْلَكَ الَّذِينَ مِنْ قَبْلِكُمْ أَنَّهُمْ كَانُوا إِذَا سَرَقَ فِيهِمُ الشَّرِيفُ تَرَكُوهُ، وَإِذَا سَرَقَ فِيهِمُ الضَّعِيفُ أَقَامُوا عَلَيْهِ الْحَدَّ، وَإِنِّي وَالَّذِي نَفْسِي بِيَدِهِ لَوْ أَنَّ فَاطِمَةَ بِنْتَ مُحَمَّدٍ سَرَقَتْ لَقَطَعْتُ يَدَهَا» (Those who were before you were destroyed because when an honorable person among them would steal, they would leave him. But, when a weak man among them stole, they implemented the prescribed punishment against him. By Him in Whose Hand is my soul! If Fatimah the daughter of Muhammad stole, I will have her hand cut off.)…

Muhammad Tahir al-Kurdi (d. 1980 in Makkah), a scholar of over four decades in the Qur'anic disciplines and a calligrapher of the Qur'an in the era of King Abdul Aziz, wrote a book on the history of the Qur'an. Bio: ar.wikipedia.org/wiki/محمد_طاهر_الكردي On the issue of whether the orthography of the Qur'an is Tawqif from revelation or Ijtihad from the Sahabah, he prefers the latter position due to five reasons, highlighted in the scans shared above: 1. The Prophet was Ummi, so how could he possibly offer detailed instructions on orthography? 2. The Sahabah differed over how to write التابوة / التابوت. Had it been Tawqif-based, there would have been no such difference. 3. Had the orthography been based on Tawqif, the Masahif of Uthman that were distributed across the main centres of Islam would not differ with one another. But the fact is they do, as is obvious to any student of the Masahif Uthmaniyyah. 4. For children specifically, Imam Malik allowed orthography that is not aligned to the Uthmanic Rasm. (Although this view in practice is not implemented, the view exists.) Had it been Tawqif-based, he would have not said this. 5. Had the orthography been based on Tawqif from the Prophet and revelation, it would not be attributed to Uthman, but rather to revelation/Prophet/Tawqif. He also repudiated the notion that the Prophet dictated the method of the words to the scribe, dismissing those reports as baseless and/or severely weak, as well as the fact that this idea is a threat to the notion of the Prophet's ummiyyah, a key tenet of the Islamic faith. The book was first published near a century ago. In later years, the Egyptian Qari and editor Ma'sarawi edited it, and added his footnotes in disagreement to what Kurdi said here. Suffice to say Ma'sarawi offered a botched job in his attempt to discredit what Kurdi said. What Kurdi says here is absolutely on the money. Hopefully this suffices in answer to the clip being circulated from Asrar Rashid, in his attempt (like all other Barelwis) in refuting Tariq Masood. Asrar claimed that the orthography is directly from the Prophet. Just because you are refuting Tariq Masood does not automatically make you correct - let alone an authority - on the subject, which is what seems to be the case worldwide with every Barelwi and his grandad.

Dear Barelwis, since this saga has been leverage the attribution of gustakhi to 'all Deobandis' (which has just been irresistible urge and itch for all of you, for the past couple of days), allow me to raise your gustakhi wager. Simply put, there is a strong case for all of you to adopt the noble Hanbali School. Allow me to explain. All the other three schools have positions that end up in gustakhi: 1. The Hanafi School's view is semen is impure. When commentating on Al-Shifa where Qadi Iyad said: وشاهد هذا أنّه صلى الله تعالى عَلَيْهِ وَسَلَّمَ لَمْ يَكُنْ مِنْهُ شَيْءٌ يُكْرَهُ ولا غير طيّب Mulla Ali Qari unfortunately said: وفيه أنه منقوض بما صح عن عائشة رضي الله عنها أنها كانت تغسل المني من ثوب رسول الله صلى الله تعالى عليه وسلم وبأنه كان يستنجي بنحو حجر ومدر وأيضا أنه لو كان الخارجان منه طاهرين لما كانا حدثين ناقضين كالعرق والدمع والبزاق والمخاط ونحوها والإجماع على أنه صلى الله تعالى عليه وسلم في نواقض الوضوء كالأمة إلا ما صح استثناؤه كالنوم بدليل أنه صلى الله تعالى عليه وسلم كان ينام عيناه ولا ينام قلبه كما سيأتي So according to Mulla Ali Qari, the فضلات of the Prophet are impure. Why do you even read his books then? In fact, when discussing the whole issue, nobody from the early school made an exception on this issue for the Prophet. The whole school is mired in gustakhi. A few statements by later scholars to the contrary doesn't cleanse this sin. 2. The Maliki School is even worse. They said all semen must be washed regardless. They don't even agree to the hadith where the Prophet would just scrape it off the clothes when dry, which is what the Hanafis say. In fact, in al-Shifa itself, Qadi Iyad alludes to the existence of both views re: the فضلات of the Prophet being pure or impure, and did nothing to de-legitimise the other view: فَقَدْ قَالَ قَوْمٌ مِنْ أَهْلِ الْعِلْمِ بِطَهَارَةِ هَذَيْنِ الْحَدَثَيْنِ مِنْهُ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَهُوَ قَوْلُ بَعْضِ أَصْحَابِ الشَّافِعِيِّ حَكَاهُ الْإِمَامُ أَبُو نَصْرِ بْنُ الصَّبَّاغِ فِي شَامِلِهِ وَقَدْ حَكَى الْقَوْلَيْنِ عَنِ الْعُلَمَاءِ فِي ذَلِكَ أَبُو بَكْرِ بْنُ سَابِقٍ الْمَالِكِيُّ فِي كِتَابِهِ الْبَدِيعِ فِي فُرُوعِ الْمَالِكِيَّةِ وَتَخْرِيجِ مَا لَمْ يَقَعْ لَهُمْ مِنْهَا عَلَى مَذْهَبِهِمْ مِنْ تَفَارِيعِ الشَّافِعِيَّةِ 3. As for the Shafi'is, well, where do we start? Ayni condemned Nawawi for what he said in al-Majmu' and called out his words as gustakhi. Nawawi said: وأما شعر رسول الله صلی الله عليه وسلم فاذا قلنا بطهارة غيره فهو أولى، والا فوجهان. قال أبو جعفر: هو طاهر وقال غيره : هو نجس Ayni said in response that this is almost kufr: ذكر وجهين في شعر النبي عليه السلام إساءة الأدب والجرأة في الإقدام بهذا الذكر الشنيع في حق هذا الجناب الرفيع، وفي اعتقادي أن مثل هذا كاد يكون كفرا، وأنا كنت أنزه نفسي عن إيراد هذه القضية السخيفة في هذه المواضع، ولكني ذكرته ليقف عليه من لم يخطر علمه به So there you have it. Get on a plane to Najd (or wherever suits you fancy) and convert to Hanbali Fiqh. I'm sure they'll welcome you with open arms. The fact that any of you can remain Hanafis (or Malikis or Shafi'is) is in itself gustakhi.

This is a masterclass in gaslighting and a power play. 'Oh it was a private sitting... oh it was taken out of context...' So was it a clarification of previous remarks, or was it him changing his mind because he got exposed? And I'm not even sure whether he actually holds this horrible view in private but had another view for the public. Not only that, it's also an utmost ignorance of Hanafi Fiqh. The Hanafi School is not only the only school that says there is no capital punishment for gustakhi, it is also the only school to say that a master cannot subject his own slave to capital punishment for a corresponding crime he may commit. The Hanafi School (which .pk has departed from) is arguably the most safest and cautious in terms of penal verdicts issued from an official court. It is also very hard to obtain a verdict of capital punishment from a Hanafi Court. Tariq Masood might be good in terms of his social commentary for the .pk masses. But he is lacking in terms of ilm. All of this is a damning indictment on his judgement. He is emblematic of the intellectual crisis surrounding the scholarly circles of Pakistan on this specific issue. As for a response by the Barelwis the world over, then their idiocy requires another post altogether.
