The Government’s proposed course confirms why dismissal must be with prejudice. The Government does not ask this Court to decide the Speedy Trial Act issue on the merits. Instead, it proposes that the Court “assume,” solely for expediency and without any concession, that a violation occurred, dismiss the Indictment without prejudice, and permit the Government to re-indict. That request should be rejected. The Speedy Trial Act is not a procedural reset button. Congress required dismissal when the Act is violated, and it required courts to determine whether dismissal is with or without prejudice by considering, among other things: the seriousness of the offense, the facts and circumstances leading to dismissal, and the impact of reprosecution on the administration of the Act and the administration of justice. 18 U.S.C. § 3162(a)(2). Here, the facts and circumstances weigh decisively against the Government. The delay is not attributable to any gamesmanship by Mr. Weeks. It is the product of the Government’s own litigation choices, its failure to timely bring the case to trial, and now its attempt to avoid a merits ruling while preserving the ability to start over. Allowing re-indictment under these circumstances would reward the very conduct the Act was designed to deter. The Government’s position also undermines the administration of justice. It asks the Court to treat a Speedy Trial Act violation as a technical inconvenience rather than a statutory protection. But the Act exists to protect defendants from prolonged unresolved criminal charges and to ensure that the Government bears the burden of timely prosecution. If the Government may simply “assume” a violation, obtain dismissal without prejudice, and refile the same case, then the sanction becomes meaningless. Dismissal without prejudice would not remedy the violation. It would merely give the Government a clean slate after years of delay. The only remedy that gives effect to the Speedy Trial Act, deters future violations, and protects the integrity of these proceedings is dismissal with prejudice.
