▪︎UNION and ITS TERRITORIES 📌 ARTICLE 2 🔸️ Article 2 empowers the Parliament to ‘admit into the Union of India, or establish, new states on such terms and conditions as it thinks fit’. 🔸️ Thus, Article 2 grants two powers to the Parliament: (a) the power to admit into the Union of India new states; and (b) the power to establish new states. 🔸️ The first refers to the admission of states which are already in existence, while the second refers to the establishment of states which were not in existence before.

▪︎UNION and ITS TERRITORIES. 📌 PARLIAMENT’S POWER TO REORGANISE THE STATES. (ARTICLE - 3) 🔸️ Article 3 authorises the Parliament to: (a) form a new state by separation of territory from any state or by uniting two or more states or parts of states or by uniting any territory to a part of any state; (b) increase the area of any state; (c) diminish the area of any state; (d) alter the boundaries of any state; and (e) alter the name of any state. 🔸️ However, Article 3 lays down two conditions in this regard: one, a bill contemplating the above changes can be introduced in the Parliament only with the prior recommendation of the President; 🔸️ and two, before recommending the bill, the President has to refer the same to the state legislature concerned for expressing its views within a specified period.

■ IS PREAMBLE A PART OF CONSTITUTION ? #Preamble ◇ In the Berubari Union case (1960), the Supreme Court said that the Preamble shows the general purposes behind the several provisions in the Constitution, and is thus a key to the minds of the makers of the Constitution. ◇ In the Kesavananda Bharati case(1973), It observed that the Preamble is of extreme importance and the Constitution should be read and interpreted in the light of the grand and noble vision expressed in the Preamble. ◇ In the LIC of India case (1995) also, the Supreme Court again held that the Preamble is an integral part of the Constitution. ◇ However, two things should be noted:- • The Preamble is neither a source of power to legislature nor a prohibition upon the powers of legislature. • It is non-justiciable, that is, its provisions are not enforceable in courts of law.

■ EQUALITY #Preamble ◇ The term ‘equality’ means the absence of special privileges to any section of the society, and the provision of adequate opportunities for all individuals without any discrimination. ◇ The following provisions of the chapter on Fundamental Rights ensure civic equality:- (a) Equality before the law (Article 14). (b) Prohibition of discrimination on grounds of religion, race, caste, sex or place of birth (Article 15). (c) Equality of opportunity in matters of public employment (Article 16). (d) Abolition of untouchability (Article 17). (e) Abolition of titles (Article 18). ◇ There are two provisions in the Constitution that seek to achieve political equality. 1. One, no person is to be declared ineligible for inclusion in electoral rolls on grounds of religion, race, caste or sex (Article 325). 2. Two, elections to the Lok Sabha and the state assemblies to be on the basis of adult suffrage (Article 326).
