When Should The Sacrificing Of The Animal Occur? Ash-Shaykh Bin Baaz, rahimahullah, was asked the following question: Question: Is the sacrificing of the animal supposed to be done on a specific day (during the days of dhul hijjah)? Answer: أما وقت الضحية فهو أربعة أيام على الصحيح من أقوال العلماء: يوم العيد وهو يوم عيد النحر وهو العاشر من ذي الحجة، ثم اليوم الحادي عشر ثم اليوم الثاني عشر ثم اليوم الثالث عشر، وقال بعض أهل العلم: إنها ثلاثة يوم العيد ويومان بعده، والصواب أنها أربعة، يوم العيد وثلاثة أيام بعده، وهي أيام التشريق، وهي أيام النحر، وهي أيام رجم الجمار، وهي أيام ذكر لله -عز وجل- وأكل وشرب، فإذا صلى الناس العيد صلاة العيد بدءوا بالذبح، يبدأ بالذبح بعد صلاة العيد كما أمر النبي -عليه الصلاة والسلام- فإنه صلى ثم ذبح As for the (appointed) time for making the sacrifice, then it is (a period) of four days according to the correct opinion of the scholars: the day of Eid, which is Eid al-Adhaa, which is the tenth day of Dhul Hijjah, then the eleventh day, then the twelfth day, then the thirteenth day. Also, some of the scholars said it is (only) for three days: the day of Eid and the two days after it. However, the correct opinion is that it is for four days, the day of Eid and the three days after it which are referred to as the days of tashriq. Therefore, when the people finish praying Salaatul Eid, they should begin with the act of slaughtering. The person should begin with the act of slaughtering after Salaatul Eid as has been commanded by the Prophet sallahu alayhi wa salam, for verily he prayed (first) then he slaughtered. [Source: Silsilatul Huda wa noor, Tape 410, Time: 0036:12] So we see from the shaikh’s statement the permissiblity of this action and the proof for his fatwa are evidences above. Hafidh ibn Rajab rahimuhuhallah said in Fath al Bari: ومراده : أن التكبير يشرع في أيام العشر وأيام التشريق جميعاً And his purpose/intent (ie, Bukhari in the chapter): is that takbir is legislated in the ten days and in the days of tashriq all together. Reciting The Takbeeraat In The Ten Days Is A Practice Of Some Of The Salaf, And It Is Not Restricted To The Days Of Tashreeq Only The issue of reciting Takbeerat in the ten days of Dhul-hijjah are allowed and the practice of some of the salaf. Proof: خرجه أبو بكر عبد العزيز بن جعفر في ((كتاب الشافي)) وأبو بكر المروزي القاضي في ((كتاب العيدين)) . ورواه عفان : نا سلام أبو المنذر -فذكره ، ولفظه : كان أبو هريرة وابن عم يأتيا السوق أيام العشر ، فيكبران ، ويكبر الناس معهما ، ولا يأتيان لشيء إلا لذلك Hafdih ibn Rajab mentions in fath al Bari: “Abu Bakr abdul aziz ibn ja’far in his book Kitab ash-Shaafi and Abu bakr al-Marawzi al Qadi in his book kitab al Eidayn report on the authority of ‘Affan from Sallaam abu al-mundhir and its his wording that: “Abu hurariah and Ibn Umar radiallah anhumaa used to come to the market in the ten days of dhul-hijjah, then make takbeer and the people would be make takbeer with them and they did not come to the market except for that.” I say (Faisal): The chain is Hasan due to Sallaam ibn sulaymaan abu mundhi who is sadooq as Abu Dawood said: Laysa bih ba’s and Abu Hatim ar-raazi said: Sadooq Salih al Hadith. The rest of the narrators are thiqaat (reliable). I say (Faisal): It is also reported by Bukhari in kitab al Eidyaan without a chain and Hafidh ibn hajr in Fath al Bari and Imam Albani also in Irwaa al Ghalil say that they could find a connected chain for it. Ibn Hajr said that Bayhaqi reported it without a chain as did Baghawi. But Shaikh Abdul Aziz at-tarifi in his book Tahjeel fi takhreej ma lam yakhruj min ahaadith wa aathar fi irwaa al ghalil also reports the chain from the same routes of Hafidh ibn rajab. I also found the narration in Akhbaar al-Makkah of Al-Faakihi with the same chain. Also Hasan. However, some of the salaf disliked that takbeerat be recited in the first ten days and some even called it bidah! Proof: حدثنا أبو بكر قال حدثنا عبد الرحمن بن مهدي عن شعبة قال : سألت الحكم وحمادا عن التكبير أيام العشر فقالا : محدث Abu Bakr ibn Abi Shaybah reported: from Abdurahman ibn mahdi from Shu’bah who said: I asked al-Hakam (ie, ibn Utaybah) and Hamaad (ie. ibn abi sulaymaan) about takbeer on the ten days of Dhul Hijjah? They said: A muhdith (innovation). [The chain is Saheeh, narrators of Bukhari and Muslim]. حَدَّثَنَا أَبُو بِشْرٍ ، قَالَ : ثنا بِشْرُ بْنُ عُمَرَ ، عَنْ حَمَّادِ بْنِ سَلَمَةَ ، عَنْ ثَابِتٍ ، قَالَ : ” كَانَ النَّاسُ يُكَبِّرُونَ أَيَّامَ الْعَشْرِ حَتَّى نَهَاهُمُ الْحَجَّاجُ ” وَالأَمْرُ بِمَكَّةَ عَلَى ذَلِكَ إِلَى الْيَوْمِ ، يُكَبِّرُ النَّاسُ فِي الأَسْوَاقِ فِي الْعَشْرِ Thabit al Bunani rahimuhullah said: The people used to make takbir on the ten days of dhul hijjah until al-Hajjah (ie. ibn Yusuf) prohibited them, and the affair was like that in Makkah until today, the people would make takbir in the markets in the ten days. [Reported by Al-Faakihi in Akhbar al-Makkah and its chain is saheeh] حَدَّثَنَا أَبُو بِشْرٍ ، قَالَ : ثنا بِشْرُ بْنُ عُمَرَ ، عَنْ شُعْبَةَ ، قَالَ : ” سَأَلْتُ الْحَكَمَ , وَحَمَّادًا عَنِ التَّكْبِيرِ ، أَيَّامَ الْعَشْرِ ، فَلَمْ يَعْرِفَاهُ Abu Bashir reported that bishr ibn umar from shu’bah said: I asked Hakam and Hamad about the takbir on the ten days of dhul hijjah. They did not know about it. [Reported by Al-Faakihi in Akhbar al-Makkah and its chain is saheeh] However we see above from the action of Abu Hurariah and Ibn Umar radiallahu anhuma and also the statement of Thabit, a taabi’i, that they and people used to do these takbeerat. The statements of Hammad and Hakam are not correct because it is not a bidah when the Sahaba perform an action. However, as we see from the above statement, Hammad and Hakam did not know about these action, may Allah have mercy upon them. — Shaikh Al-Albani rahimuhullah said about the takbeerat on the days of Dhul hijjah: Question: Are the takbeer in the days of Tashriq restricted to only after the salawaat? Answer: No, no, it is not restricted. Rather, this restriction is from the bidah. Verily the takbeer is for every time in days of tashriq. Questioner:

If You Intend To Sacrifice During The Ten Days Of Dhul-Hijjah, Do Not Cut Your Hair Or Trim Your Nails Ash-Shaykh Saalih al-Fawzaan, may Allah preserve him, said : حلق الشعر وتقليم الأظافر لا يجوزان في عشر ذي الحجة لمن أراد أن يضحي، أو أن يأخذ شيئًا من شعره أو أظافره في عشر ذي الحجة، حتى يذبح أضحيته؛ لنهيه صلى الله عليه وسلم عن ذلك ‏؛ كما في حديث أسماء رضي الله عنها، أما مجرد تسريح الشعر الذي لا يحصل معه زوال شيء من الشعر؛ فلا بأس به‏. “Cutting the hair and trimming the nails is not allowed for the one who intends to make a sacrifice during the ten days of Dhul Hijjah. (Similarly), or to remove any piece of hair from himself or from his nails during the ten days. (This is) until he slaughters his sacrifice due to the prohibition of the Prophet sallahu alayhi wa salam from that, as comes in the hadeeth of Asmaa, may Allah be pleased with her. As for hairstyling only which doesn’t cause pieces of the hair to fall off, then that is okay” Reference: Muntaqaa min Fataawa al-Fawzaan Translated by AbdulFattaah bin Uthman Abu Fajr Question: Regarding not cutting one’s hair, does this also apply to the family members if a sacrifice is made on behalf of the family by the father? Answer: Shaykh Ibn Uthaymeen said: وهذا الحكم خاص بمن يضحّي، أما المضحَّى عنه فلا يتعلق به؛ لأن النبي قال: { وأراد أحدكم أن يضحي… } ولم يقل: أو يضحّى عنه؛ ولأن النبي كان يضحّي عن أهل بيته، ولم يُنقل عنه أنه أمرهم بالإمساك عن ذلك This ruling is specific to the one slaughtering. As for the one whom the slaughter is made on behalf of, then it’s not connected with him, because the prophet صلى الله عليه و سلم said “if one you wishes to slaughter” and he didn’t say “or the one whom on his behalf it’s being slaughtered”. بسم الله الرحمن الرحيم Benefits Regarding Dhul-Hijjah Allaah swore by the 10 nights of Dhul-Hijjah as Allaah, the Most High, said: وَلَيَالٍ عَشْرٍ By the ten nights (i.e. the first ten days of the month of Dhul-Hijjah). [Al-Quraan 89:2] Ibn Katheer, may Allaah have mercy upon him, said about this Verse: "The ten nights' refers to the (first) ten of Dhul-Hijjah. This was said by Ibn `Abbaas, Ibn Zubayr, Mujaahid and others among the Salaf and the latter generations." Ibnul-Qayyim, may Allaah have mercy upon him, said: "Verily the dawn of the ten nights is a time period that contains actions that are magnified by rituals & magnified places, and it is from the rites of Allaah which entails humility of a servant to his Lord for verily Hajj and its rites is a worship solely for Allaah which necessitates humility and submission to his his greatness, and these traits are the opposite of the traits of the people of 'Aad, Thamuud & Pharaoh from that which they had from haughtiness, arrogance and pomposity. Those nations were a transgressive people who were too prideful to carry out the commands of their Lord, so a time period which contains such righteous actions is deserving to be sworn upon by the mighty and Majestic Lord". [Badaa'I At-Tafseer, Vol. 3, Pg. 296] It Is Considered To Be From The Forty Days That Allaah Appointed Muusaa عليه السلام With وَوَاعَدْنَا مُوسَىٰ ثَلَاثِينَ لَيْلَةً وَأَتْمَمْنَاهَا بِعَشْرٍ فَتَمَّ مِيقَاتُ رَبِّهِ أَرْبَعِينَ لَيْلَةً And We appointed for Muusaa (Moses) thirty nights and added (to the period) ten (more), and he completed the term, appointed by his Lord, of forty nights. [Al-Quraan 7:142] Imaam As-Sa'dee, may Allaah have mercy upon him, said: "Once Allaah completed his blessing upon them and saved them from thier enemy, and gave them succession in the land, Allaah Intended to complete his favour upon them by revealing to them a book in which was the legislative rulings and praiseworthy creed, so he appointed to Muusaa عليه السلام thirty night's and completed it with another ten so it became forty to prepare Muusaa عليه السلام for the promise of Allaah, so that it's revelation becomes one of great significance amongst them (bani Israaeel) and that he (Muusaa) becomes in a state of anticipation for it." [Tafseer As-Sa'dee, Pg. 280] Ibn Katheer, may Allaah have mercy upon him, said: "Indeed the interpreters of the Quraan have differed with regards to these ten (mentioned in the Verse) and what they are. The majority (of scholars) say the thirty are Dhul-Qa'dah and the ten are Dhul-Hijjah. This was stated by Mujaahid, Masrooq & Ibn 'Abbaas. So upon this, Muusaa عليه السلام completed his appointed term by the day of An-Nahr (the day of slaughtering) and this is when Muusaa عليه السلام was spoken to by Allaah." Shaykhul-lslaam Ibn Taymiyyah, may Allaah have mercy upon him, said, “All praise be to Allaah. The most correct saying concerning the takbeer – that which the majority of the Salaf (pious predecessors), and the scholars from the Companions and imaams were upon – is to begin making the takbeer from Fajr (dawn) on the day of ’Arafah, up until the last day of At-Tashreeq (the thirteenth of Thul-Hijjah), af ter every prayer.” [Majmuu’ul-Fataawaa, 24/220]. However, what seems more correct is not to restrict the takbeeraat to being just after every prayer, as Al-Haafith Ibn Hajr pointed out in Fathul-Baaree, 21/587. Ibn Abee Shaybah relates, “That ’Alee, may Allaah be pleased with him, used to make the takbeer beginning after the Fajr prayer on the day of ’Arafah, up until after the ’Asr Prayer on the last day of At-Tashreeq.” [Al-Musannaf, 2/1/2. Authenticated by shaykh Al-Albaanee in Al-lrwaa‘, 31/125]. As regards the actual wording of the takbeeraat, then nothing authentic has been related from the Prophet (sallAllaahu ’alayhi wa sallam). However, certain wordings have been authentically related from a group of Companions such as the wording of 'Abdullaah Ibn Mas’uud, may Allaah be pleased with him, who would say, “Allaah is great, Allaah is great. None has the right to be worshipped except Him, and Allaah is great, Allaah is great and to Him belongs all praise. [Allaahu akbar, Allaahu akbar,, Laa ilaaha illAllaah, wAllaahu akbar, Allaahu akbar wa lillaahil-hamd]” [Ibn Abee Shaybah with an authentic chain of narration]. Refer back to Fathul-'Allaam (a research on Buluughul-Maraam) by shaykh Muhammad Hizaam, second volume, page 197 and Miskul-Khitaam (an explanation of 'Umdatul-Ahkaam) by shaykh Zaayid Al-Wusaabee, second volume pages 114 - 115 for more on this topic. Unfortunately, many Muslims have neglected the takbeer established from our Salaf (pious predecessors) and have instead resorted to additions which have no basis at all. Al-Haafith Ibn Hajr, may Allaah have mercy upon him, said, “Indeed, additions have been invented upon this day, which have no basis at all.” [Fathul-Baaree, 2/536]. And may Allaah have mercy upon the one who said, “Every good is in following the Salaf; And every evil is in the innovations of the late-comers.” And all praise is for Allaah, Lord of the worlds. And may Allaah extol and send blessings and peace upon our Leader, Muhammad, and upon his Family, his Companions, and all those who follow them until the final Day.
