*Awareness Circular to All GDS Regarding TRCA Upgradation and Recovery.* It has come to the notice that in several divisions, recovery of TRCA difference is being initiated from the salary of GDS by citing the Directorate clarification dated 14-11-2025 regarding fixation of TRCA of newly engaged GDS. In this connection, the following facts may kindly be noted by all GDS: As per Directorate guidelines, the workload of a Branch Office should be reviewed after completion of one year of engagement through statistical review. Based on such statistical review and workload assessment, the competent authority may recommend upgradation of TRCA from Level-1 to Level-2 wherever the workload justifies the higher slab. In many cases, such statistical reviews were duly conducted and TRCA was upgraded from Level-1 to Level-2 by the competent authority after proper verification of workload. Accordingly, the concerned GDS have been drawing the upgraded TRCA for several years based on official orders issued by the department. However, in some divisions recovery proceedings have now been initiated after several years, in certain cases even after a lapse of nearly eight years, which has caused serious concern and hardship to the affected GDS. It must be clearly understood that: • The TRCA upgradation was granted based on official statistical review and approval by the competent authority. • The GDS concerned had no role in the fixation of TRCA, as the pay was determined by the department itself. • Recovery after such a long lapse of time causes severe financial hardship to low-paid GDS employees. • Even after eight years of implementation of the revised TRCA structure, a clear and uniform review mechanism has not been properly formulated, which itself reflects an administrative lapse. Further, as per the principles laid down by the Hon’ble Supreme Court in the case of State of Punjab v. Rafiq Masih, recovery of excess payment should not be made from low-paid employees when the excess payment occurred due to administrative error and without any misrepresentation by the employee. In the present cases, the payment of upgraded TRCA was made based on official departmental review and orders, and therefore the GDS concerned cannot be held responsible for such fixation. Hence, initiating recovery after such a long lapse of time appears to be unjust and contrary to the principles of fairness and natural justice. All affected GDS are therefore advised to submit a detailed representation to the Divisional authorities through proper channel, requesting withdrawal of recovery and reconsideration of the matter. If proper relief or satisfactory reply is not received from the department, the affected GDS may approach the Central Administrative Tribunal (CAT) seeking appropriate legal remedy against such recovery.
