#readingFriday Read the text The Laws of Armed Conflict (LOAC) are a set of international rules that apply to armed conflict. They aim to protect people who are not, or are no longer, taking part in the fighting and to limit the methods and weapons used in war. The LOAC is also known as the Law of War or International Humanitarian Law. It includes the principles of distinction, proportionality, and military necessity. The principle of distinction states that combatants must be distinguished from non-combatants at all times. A combatant is a member of the armed forces who takes an active part in the hostilities, while a non-combatant is a civilian or a member of the armed forces who is hors-de-combat, which means they are unable to fight because they are wounded, sick, shipwrecked, or captured. Indiscriminate attacks that do not distinguish between combatants and non-combatants are prohibited. For example, area bombardment of cities is not allowed, as it would cause collateral damage to civilians. The principle of proportionality states that the harm caused by an attack must not be excessive in relation to the military advantage gained. This means that if there is a risk of causing significant civilian casualties, the attack should not be launched if the expected military advantage is minor. The principle of proportionality applies to both the choice of targets and the methods and weapons used in an attack. For example, attacking protected buildings that are not being used for military purposes is prohibited. The principle of military necessity allows for the use of force that is necessary and proportional to achieve a legitimate military objective. However, it does not justify the use of any means or methods of warfare. Certain types of weapons are considered indiscriminate and therefore prohibited, such as chemical, biological, and nuclear weapons. Other weapons may be lawful but can only be used under certain conditions. For example, landmines are permitted in some cases, but their use is subject to strict rules. The LOAC also includes rules for the treatment of prisoners of war (POWs). A POW is a combatant who has been captured by the enemy during an armed conflict. They must be treated humanely and protected from violence, intimidation, and public curiosity. They have the right to receive medical care, to send and receive letters, and to be repatriated at the end of the conflict. They must not be subjected to torture, cruel treatment, or any form of punishment that goes beyond what is necessary for security reasons. In recent years, there has been increasing concern about the violation of LOAC principles in various conflicts around the world. There have been reports of attacks on civilians, hospitals, and other protected buildings, as well as the use of prohibited weapons. These violations are often committed by non-state armed groups that are not bound by international law. However, even state parties to the Geneva Conventions have been accused of LOAC violations, including the mistreatment of detainees and the killing of unarmed civilians. It is essential that all parties to an armed conflict respect the LOAC and take steps to ensure compliance. This includes providing training and education to military personnel, conducting investigations into alleged violations, and holding those responsible accountable for their actions. It is also important for the international community to condemn LOAC violations and to provide assistance and support to the victims.
