In Seeking Dismissal of Terrorism Charge, J5 Pipe Bomber's Counsel Makes Case for DOUBLING CHARGES! Brian J. Cole Jr., the accused and confessed J5 Pipe Bomber, was arrested in December 2025 on a complaint charging two counts: transportation of an explosive device and use of an explosive device. A month later, an indictment, followed shortly by a superseding indictment, included those same two charges. In April 2026, prosecutors filed a second superseding indictment adding two more charges: attempted use of a weapon of mass destruction and an act of terrorism. The defense is now seeking to dismiss the act-of-terrorism charge as duplicitous and because the indictment fails to articulate the elements of the offense. But in arguing for dismissal—or, in the alternative, a clarifying brief and/or a bill of particulars—Cole’s counsel do a pretty good job of (accidently) explaining how their client’s charges could be doubled. Cole was charged as if his assembly, transportation, and planting of the devices at two separate locations were one continuous act, with each count mentioning both the DNC and RNC. If prosecutors obtained a third superseding indictment charging the same offenses but tailored to each location, the deficiencies Cole’s attorneys highlight in the act-of-terrorism charge would be substantially or wholly remedied. J5 Pipe Bomber Renews Motion for Kerkhoff Material Brian J. Cole Jr. is charged with assembling and planting pipe bombs at the DNC and RNC headquarters on January 5, 2021. Following his arrest last December, Cole confessed to purchasing the materials, assembling the bombs, and planting them. But even if you confess to a crime, you are still entitled to a defense (and Cole's defense team will inevitably seek to get his confession thrown out). One of the things Cole's defense team has been seeking since April are materials from the FBI’s investigation of former Capitol Police officer Shauni Kerkhoff, who was briefly a person of interest in the pipe bomb investigation. Last November, as the FBI was closing in on Cole but before they made their arrest, some information was given to the FBI indicating that she may have something to do with the pipe bombs. The FBI followed up on the information and took some investigative steps regarding Kerkhoff. Rather quickly, though—within two or three days—they concluded she had nothing to do with the bombs. At the same time the FBI was looking into Kerkhoff, The Blaze published multiple articles identifying her as the pipe bomber. Those articles were later retracted, and their authors, Steve Baker and Joseph Hanneman, left The Blaze shortly afterward. (It's almost like some invisible hand, perhaps belonging to a disgruntled person who may have at one time worked for the FBI, was trying to sabotage their investigation right as it was closing in on the real pipe bomber... hmm, funny that. Anyway…) Despite the retractions of the articles, Cole’s indictment and confession, the evidence against Cole, and the absence of any evidence tying Kerkhoff to the bombs, Baker and Hanneman continued to argue, and as far as I know still do, that Cole is an innocent patsy and Kerkhoff the actual bomber. Their campaign led to a defamation lawsuit by Kerkhoff against The Blaze, Baker, and Hanneman. She filed it in April. From the earliest days of that civil case, attorneys for Cole have been working with Baker and Hanneman. This was not disclosed until June when they officially filed to represent them in the civil case. The two matters look, and are, connected: Cole’s team wants the FBI’s Kerkhoff files so it can suggest to a jury that the FBI charged the wrong person. In a criminal case, sowing reasonable doubt can be enough. In the civil case, Baker and Hanneman appear to want those same materials to argue that the leaks behind their now-retracted articles had some basis in fact, because the FBI really did investigate Kerkhoff. Additionally, Cole's team has also filed a motion to dismiss Count 4 of the indictment, which charges Cole with an act of terrorism. More on that in the next video. Ex-Fauci Adviser Takes Plea Deal in Conspiracy Case Over Concealed COVID Records Dr. David M. Morens served as a senior advisor in NIAID’s Office of the Director from 2006 to 2022. Meaning, he was Fauci's right-hand man for some 16 years. During the COVID-19 pandemic, Morens, two co-conspirators, and others conspired to have an NIH grant for bat coronavirus research reinstated after it had been cancelled by the NIH due to information emerging that pointed at the Wuhan Institute of Virology as being the source of the COVID-19 outbreak. They also sought to push through a separate $7.5 mil grant from the NIH to EcoHealth and Boston University for a new research initiative into emerging viruses. To these ends, Morens and others concealed information, deleted records, and misled officials, the scientific community, the media, and the public, steering discussions and inquiries away from any lab-leak theory, away from critical inquiry into EcoHealth and the WIV, thus undermining the investigation into the origins of the pandemic. Moren is charged with: Count 1 - 18 USC 371 - Conspiracy Against the United States Counts 2 & 3 - 18 USC 1519 - Destruction, Alteration, or Falsification of Records in a Federal Investigation Counts 4 & 5 - 18 USC 2071 - Concealment, Removal, or Mutilation of Records Morens is facing up to 46 years in prison if convicted. Or was, anyway. He has now accepted a plea deal for just one count of conspiracy. Instead of facing decades in prison, he is now looking at an absolute maximum of up to only 5 years in prison, 3 years of supervised release, and a $250,000 fine. Something to keep in mind: Investigators obtained ~600 boxes of records from the Fulton County warehouse back in January 2026. Due to a legal battle that sought the return of those boxes, they were not allowed to dig into the records until May 2026. Bishop issued the now-quashed subpoena in late April 2026; Fulton County took it to court in May 2026. So, Bishop did not have any of the materials in the 600 boxes to review or use in support of his now-quashed subpoena. Investigators have now been going through those 600 boxes for three to four months. It will be very interesting to see what U.S. Attorneys Albus and Bishop do with whatever investigators find in those boxes.

Earlier this year, Dan Bishop, the U.S. Attorney for the Middle District of North Carolina and one of at least two U.S. Attorneys empowered by the Attorney General to conduct the probe, sought the contact information and job descriptions of hundreds of people (possibly more than a thousand) who worked for, contracted with, or volunteered for Fulton County in the 2020 election. Fulton County fought the subpoena and won. A district judge quashed it last month. (See this post - https://t.me/realjust_human/18106 ) Bishop has now filed an appeal with the 11th Circuit. I do not expect the appeal to work, by the way. The better course is probably to seek a new subpoena that is much narrower in scope and grounded in the same probable cause that the other U.S. Attorney working this probe, Missouri U.S. Attorney Thomas Albus, successfully used to obtain search warrants for Fulton County’s warehouse.

The added charges include wire fraud conspiracy, conspiracy to submit false statements to a bank, and concealment money laundering. The new defendant is Heidi Beirich, the former chief financial officer of the SPLC, who the DOJ says participated in the conspiracies, the filing of false statements to banks, and laundering payments to informants. SPLC Says Federal Law Enforcement Used Some of the Same Informants —"What's the difference?" The SPLC has filed a motion to compel production of exculpatory evidence that it says is in the possession of the DOJ, FBI, DHS, and other federal agencies with which it has previously assisted or worked. The organization cites instances in which the same informants it paid and used to infiltrate extremist groups were also paid and used by federal law enforcement for the same or similar work. Specifically, the SPLC is seeking: 1) documents or information showing cooperation between the SPLC and federal law enforcement; 2) documents or information showing that federal law enforcement directly engaged with, or used as informants, the same individuals the SPLC used as informants; and 3) documents related to taxes paid or not paid by the informants who worked with the SPLC. Such information could support an argument against the indictment that essentially asks the jury, “What’s the difference?” Prosecutors have previously informed the court that they have already produced all of the exculpatory information required by law, plus additional material. The very next day, it was taken away from him and given to Special Counsel Mueller. We’ve long known this took place, but we never knew the name of the investigation, and the versions of these memos that were released years ago had more redactions than the new ones do. DOJ's Subpoena for Fulton County 2020 Election Worker Info QUASHED by District Court Fulton County, represented by Norm Eisen, Abbe Lowell, et al., has succeeded in quashing a subpoena for the contact information of thousands of workers and volunteers who worked the 2020 election, recount, and audit in the county. The judge found that the subpoena amounted to a fishing expedition, as it was overly broad, would not lead to information that could lead to charging anyone (the statute of limitations bars prosecution), the affidavit the DOJ used to support the subpoenas was "not compelling," and enforcing the subpoenas would have a chilling effect on workers and volunteers participating in future elections. Ultimately, the subpoenas do not pass the reasonableness test, and the burden they would place on Fulton County plus the privacy interests that would be set aside should they be enforced would FAR outweigh any benefit they could provide to the DOJ's probe of the county and the 2020 election. DOJ can try again, but to succeed in getting this info, they're going to need to narrow the scope of the subpoena and provide a stronger basis for it. But... as part of the stipulation, Bolton agrees that the DOJ had the evidence to convict him on all other counts AND that the plea agreement should be "treated as if the Defendant had been convicted of the additional counts..." This is important because it takes Bolton's offense level up a few points. Parties stipulate that: - A prison sentence of "no greater than 60 months" and a fine of $2.25 million are appropriate. - Bolton also agrees to engage in up to 100 hours of community service for DOJ. - Bolton also agrees to have a nice, long chat with members of the USIC and DOJ. Sentencing is scheduled for Oct 28, 2026. I doubt Bolton gets prison time, but hey, it could happen. Let's take a step back and think about what this is all about: Bolton sent drafts of his tell-all book, basically just stories about his time in the Trump Admin, to his wife and daughter for them to review and give feedback on. His crime was including information in those drafts that was classified (transmission) and keeping digital and/or hard copies of those drafts (retention).
