📍 Why in News?
🟢 The Supreme Court, in Shiv Pratap Singh v. State of U.P. and Himanshu Srivastava v. State of U.P., ruled against the manner in which the U.P. Gangsters and Anti-Social Activities (Prevention) Act, 1986 was being applied.
📍 Core Issue
🟢 A “gangster” must be defined under the Act itself, while determination for punishment cannot be left entirely to the executive or subordinate rules.
🟢 Creation of an offence and prescription of punishment are legislative functions.
