Egyptian Shāfi‘ī authority, Shams al-Dīn Muḥammad ibn Abi ‘l-‘Abbās al-Ramlī (919 – 1004 AH), states: “A multitude of the salaf like al-Ḥasan al-Baṣrī and others opined that there is no reprehensibility in gathering on the day of ‘Arafah outside of ‘Arafah, and Aḥmad said there’s no problem with it. Others deemed it reprehensible like Mālik. However, they did not include it in the ugly innovations but (merely) lessened its significance. This is provided it is free of men intermingling with women. Otherwise, it is the worst of innovations.” (Nihāyat al-Muḥtāj, 3:297)
A somewhat later Egyptian Shāfi‘ī scholar, Sulaymān ibn Muḥammad al-Bujayrimī (1131 – 1221 AH), similarly states: “People gathering after ‘Aṣr for du‘ā’ like the people of ‘Arafah do, Imām Aḥmad said there’s no harm in it while Imām Mālik deemed it reprehensible. Al-Ḥasan practised it and he was preceded by Ibn ‘Abbās. Al-Nawawī said it is a good innovation. Shaykh al-Ṭūkhī said it is ḥarām given what it entails of women intermingling with men as is observed today.” (Ḥāshiyat al-Bujayrimī ‘alā Sharḥ al-Khaṭīb ‘alā Matn Abī Shujā‘, 2:455)
Al-Sharqāwī (d. 1226) described al-Ṭūkhī’s comment as being “sound” (wajīh). (Ḥāshiyat al-Sharqāwī ‘ala ‘l-Taḥrīr, 2:28; Bughyat al-Mustarshidīn, 1:607)

| 18 | Determining Zakāt Eligibility in the Ḥanafī Madhhab: Gold or Silver Niṣāb?

“In conclusion, it is incorrect to use the gold niṣāb to assess whether someone is eligible to receive Zakāt. Instead, it is necessary to use the silver niṣāb, given its lower value. According to the Ḥanafī madhhab, if someone owns surplus possessions valued at or above the silver niṣāb but less than the gold niṣāb, they are not eligible to receive Zakāt.”
