1. What is a Narco Test? Narco-analysis = an investigative technique where the subject is administered barbiturates (e.g., Sodium Pentothal) to lower inhibitions and reasoning capacity. Used to extract concealed information, similar to polygraph and brain-mapping tests. It is non-violent, but constitutionally sensitive because it interferes with: * Mental autonomy * Cognitive liberty * Right to silence 2. Why Are Narco Tests Constitutionally Problematic? A. Article 20(3) – Protection against Self-incrimination “No person accused of an offence shall be compelled to be a witness against himself.” Narco tests = compelled testimony → violates Art. 20(3) unless free, informed consent is given. B. Article 21 – Right to Life & Personal Liberty (includes Privacy) Narco tests interfere with: * Bodily integrity * Mental privacy * Decisional autonomy Supreme Court in Maneka Gandhi v. Union of India (1978) created the Golden Triangle: Articles 14 + 19 + 21 must be read together → any procedure must be fair, reasonable, non-arbitrary. Forced narco tests violate all three. C. Ethical Concerns * Violates autonomy, dignity. * Immanuel Kant → ethical acts must be done with consent, not coercion. 3. Key Supreme Court Guideline: Selvi v. State of Karnataka (2010) Selvi judgment held that: * Narco-analysis, polygraph, brain-mapping cannot be conducted without consent. * Test results not admissible as evidence unless voluntary, and corroborated. * Consent must be: * Informed * Recorded before a Magistrate * With medical + legal safeguards 4. 2025 Supreme Court Verdict (Amlesh Kumar v. State of Bihar) Key points: * Forced/involuntary narco test = unconstitutional and invalid. * Patna High Court order permitting forced test was struck down. * Reaffirmed Selvi guidelines. * Such tests violate Article 20(3), Article 21, and the Golden Triangle. 5. Evidentiary Value of Narco Tests * In Manoj Kumar Saini v. State of MP (2023) → Narco results do NOT confirm guilt. * In Vinobhai v. State of Kerala (2025) → Test results contribute only to investigation, not proof. * Must be corroborated with independent evidence. 6. Can an Accused Volunteer for Narco Test? Yes — as per Section 253 of BNSS (stage of defence evidence). But: * No indefeasible right to demand it. * Must follow all procedural safeguards. 7. Why the State Cannot Force Narco Tests? Because it violates: * Right to Privacy * Right to Mental Autonomy * Right to Silence * Bodily integrity
