An aggressive group of "protestants" with provocative posters was filmed by local media. In Cherkasy on May 7th, a group of so-called activists staged a provocation outside the building of the Sosnivka District Court during a hearing on another case involving Metropolitan Theodosiy of Cherkasy and Kaniv. The video was published on the YouTube channel of the Cherkasy Eparchy. The provocateurs brought posters with inscriptions such as "Down with the Moscow priest," "Theodosiy behind bars," "Why did the court release Theodosiy for the Easter night service," and so on. When the bishop was leaving the court building, they began shouting insults at him, while believers at that time greeted the hierarch with the words "Christ is Risen!" The "rally" was covered by local media. According to the position conveyed by the protester Denis Hayda to "Suspilne. Cherkasy", he is allegedly dissatisfied with the fact that the metropolitan was allowed to perform the Easter service. "Concerned citizens held a rally before Easter near the largest UOC-MP cathedral in Cherkasy. Given that this is the day when the largest number of citizens attend church, we wanted to draw attention to the fact that it is not worth going to consecrate Easter in the Moscow church, the head of which, Theodosiy, is currently under trial. We were outraged by the fact that the court allowed Theodosiy to conduct the service on Easter night, despite the fact that he should be under night house arrest. I don't understand why they mitigate the measure of restraint for him and accommodate him," the provocateur expressed his indignation. The publication also quoted a believing resident of Cherkasy who came to support the bishop: "They are judging our bishop. We, as a community, came to support him because he is our Vladyka." In response to the provocative question from the journalist about whether another believer, Olga, knows that the bishop is a representative of the Moscow Patriarchate, she replied: "Our church is a thousand years old, and Moscow was not even close then. Our great-great-grandfathers used to go to our Church." The woman also added that, according to the journalist's logic, the recently created Poroshenko's Orthodox Church should be called the Turkish Orthodox Church. "Bartholomew is Turkish, right? So why don't you say that the OCU is Turkish? Why haven't you labeled it like that? The Cherkasy hierarch is convinced that the cleric acts out of selfish motives and due to personal animosity towards him as the head of the Cherkasy Eparchy of the UOC. Three criminal cases have been opened against Metropolitan Theodosiy of Cherkasy and Kaniv, with former UOC priest Iosif Zasansky, who backslid into the schism and is banned from  priesthood, now a cleric of the OCU, and his son Nazariy, a chaplain of the OCU, acting as 'victims' in all cases. This was revealed by the bishop during a court hearing on May 7th regarding a new criminal case against him. The Cherkasy Metropolitan noted that currently two criminal proceedings have been opened against him under Part 1 of Article 161 of the Criminal Code of Ukraine, and one under Part 1 of Article 161 and Parts 2-3 of Article 436 of the Criminal Code of Ukraine. "In all the aforementioned criminal proceedings, the Zasansky family  – father and son – are the 'victims.' I believe that this persecution by the Zasansky family against me, as the Metropolitan of Cherkasy and Kaniv, is due to their hostile attitude towards me as the head of the Cherkasy Eparchy of the Ukrainian Orthodox Church, as well as purely selfish motives," said the bishop. According to the Metropolitan, the Zasansky family's actions are driven by animosity towards him because of his position regarding the OCU. Additionally, there are selfish motives involved: after the forcible seizure of the Nativity of the Most Holy Theotokos Convent in November 2023 with the help of his son, Zasansky-father effectively became its "head and master". The hierarch recounted that Iosif Zasansky  was banned from priesthood in November 2023. In January 2024, Zasansky junior turned to the Security Service of Ukraine, accusing the Metropolitan of spreading "false information" about the raider seizure of the shrine. Metropolitan Theodosiy is convinced that these cases are fabricated with the aim of removing him from the administration of the Cherkasy Eparchy of the UOC and seizing the eparchy's churches. He notes that the same witnesses and experts appear in his cases: "It feels like they work for the Security Service of Ukraine in the Cherkasy region or owe it something." The Metropolitan does not admit his guilt and hopes for an impartial consideration of the case by the court. He also needs a surgical intervention, but it is necessary to prepare for the operation. The disease was so severe that the doctor prescribed painkillers. "But even three pills didn't help, I gave him injections. He was treated for 5-6 months, there was an improvement, probably due to appropriate care. This delayed the operation. But from September 2023, the condition got worse. He went to the doctor again. And it was confirmed that surgery is necessary. Preparatory treatment is required again. The doctor prescribed not just to take medicine, but to improve overall health. Because with each appointment, the doctor observed a change in skin color, deterioration. Frequent dizziness, tinnitus. Tests revealed low hemoglobin – 51" "The doctor prescribed to have treatment in hospital. But the family physician prescribed diets that were maintained at home – a protein diet, because his disease is connected with fragile blood vessels that burst and bleeding begins... We need pomegranate juice, liver. But the pain started again and I gave injections again." After the detention and admission of lawyers to Father Sergey, they noted tha the client's health got worse, and they told his wife about it. "It is clear that now there is no proper care there (in the prison), there is no proper food. If he has pain, who will help? He will not be able to be in his state in those conditions. I ask you to release him for treatment by changing the measure of restraint." 🗣Judge: "This is a testimony about health conditions, nothing more. Have you told all?" ❗️The priest's wife: "He is the best father, and recommendations are given to him not only by relatives, but also by people who communicated with him, he saved many." ❓Attorney-at-law, Prot. Nikita Chekman asked clarifying questions. Father Sergii was always cared for by his wife, who made what he needed due to his health condition according to the diet prescribed by doctors – only boiled veal, half-cooked liver, pomegranate juice. "In the conditions that he is now, it is impossible. It will no longer be the same in terms of benefit, in 3 days they will pass it on to him. It turns sour. He needs freshly squeezed juice, in glass, or an open bottle cap – no one (the guards in the pre-trial detention center) will accept this from me. Fr. Sergiy Chertylin's lawyer, Fr. Nikita Chekman, commented on today's court hearing on a new measure of restraint for a prisoner of conscience. "During the court hearing, the court, unfortunately, did not take into account all the circumstances indicated by the defense, and extended the term of Fr. Serhiy's detention for more than 1 month. Also, the medical condition of Fr. Sergey, which became much worse, was not taken into account. All available medical documentation were presented." A particularly egregious fact, lawyers discovered was violation of the deliberation room secrecy. While being the deliberation room the judge was visited by the investigator of the SBU Oleh Savenko and the prosecutor of the Kyiv Regional Prosecutor's Office Dyadyuk. "In this regard, relevant complaints will be filed with the High Council of Justice, applications will be submitted to law enforcement agencies, because this is disgusting arbitrariness and outright audacity on the part of law enforcement agencies. We believe that this case showed the pressure exerted on the judge. The investigator and the prosecutor probably told the judge what decision he should make and so on. Serhiy Chertylin, the SBU investigator Savenko and the prosecutor Dyadyuk entered the room. According to Art. 367 of the Criminal Procedure Code of Ukraine, no one has the right to be in the jury room during the passing of the verdict, except for the composition of the court that conducts the trial.
