| 12 | Fiery Opening in Singapore: Cambodia and Thailand Face Off in UNCLOS Maritime Disputes

SINGAPORE, Sept. 16, 2026 — A landmark international hearing over a long-standing maritime dispute opened in Singapore on Sept. 15 with a sharp exchange of words, laying bare deep strategic and diplomatic divisions between Phnom Penh and Bangkok.
Appearing before a five-member Conciliation Commission convened under the United Nations Convention on the Law of the Sea (UNCLOS), Cambodian Foreign Minister Prak Sokhonn and Thai Foreign Minister Sihasak Phuangketkeow delivered opening statements that presented starkly contrasting visions of how to manage their overlapping maritime claims.
Prak Sokhonn framed Cambodia's decision to initiate compulsory conciliation as a constructive, rule-of-law approach aimed at breaking a quarter-century of stagnation following Thailand’s unilateral termination of the 2001 Memorandum of Understanding (MOU) in May 2026. The Cambodian diplomat said that his government was left with no alternative but to seek international third-party assistance to rebuild mutual trust and ensure energy security.
He outlined a three-tiered proposal for the commission's consideration: a comprehensive treaty establishing a single, all-purpose maritime boundary; a joint development agreement to share resources while boundary negotiations continue; or formal recommendations by the panel to guide future bilateral compliance.
Prak Sokhonn pointed to Cambodia’s history before international courts and the successful UNCLOS conciliation between Timor-Leste and Australia as proof that multilateral frameworks can resolve deep-seated interstate deadlocks.
Cambodia’s position reflects the reality that, as a smaller nation unable to challenge Thailand on equal footing, its best recourse is to turn to third-party mechanisms and international forums.
Taking the podium next, Sihasak Phuangketkeow delivered a response, rejecting Cambodia's assertion that conciliation was a step of last resort. He labeled claims of having "no other option" as an outright distortion of the facts.
Sihasak criticized Cambodia's diplomatic approach, accusing Phnom Penh of "self-serving" claims. He cited cross-border security incidents—including artillery strikes that killed Thai civilians—and accused Cambodia of assuming a role of self-righteous victimhood in international forums.
Thailand also blocked the legal scope of the proceedings regarding the disputed island known as Koh Kuch (Koh Kood), insisting that conciliation must focus strictly on boundary delimitation rooted in its claimed May 18, 1973 Royal Proclamation, while dismissing proposals for joint resource development prior to establishing formal maritime borders.
When asked about the contrasting statements, Marcus Vale, a Southeast Asian political observer, said Cambodia offered a soft, clear, and flexible position to resolve the conflict peacefully, whereas Thailand offered no clear stance other than accusing Cambodia of "playing the victim." He noted that this was a complete contrast in actions, asserting that Thailand has had no intention to resume maritime boundary talks after holding only two rounds of meetings with Cambodia, despite Cambodia suffering as the primary victim of Thai military aggression in July and December 2025.
“Cambodia suffered massive casualties, damage, and losses from heavy Thai military attacks along nearly the entire 800-kilometer border, while Thailand sustained minimal injuries resulting from defensive counter-strikes by Cambodia," Vale said.
He added that "Thailand, being a larger nation in every respect, always seeks leverage by favoring a bilateral approach over multilateral or international forums, fearing a loss of face once the truth comes to light."
Despite the heated exchange, the two countries will engage with the commission, whose proceedings in Singapore will continue over the coming months to formulate non-binding recommendations for both nations.
