Today, we hear the oral arguments regarding a New Hampshire election law controversy that has been brewing since 2017. Daniel Richard contends that the U.S. Constitution, Article 1, section 4, delegates to the legislatures of the several states, the duty to establish the time, manner, and place for holding federal elections. The recent opinion from SCOTUS decided June 27th, in Moore v. Harper, 600 U.S.__ (2023) now reinforces Mr. Richard's case: "Nothing in [the Elections] Clause instructs, nor has this Court ever held, that a state legislature may prescribe regulations on the time, place and manner of holding federal elections in defiance of provisions of the State's constitution."
