*The Gujarat High Court,* in its judgment dated 24 July 2026, in R/Special Civil Application No. 9212 of 2026 and connected petitions, has delivered an important ruling regarding the counting of past teaching experience for direct recruitment to the post of Assistant Professor.
The matter arose from recruitment undertaken by *Maharaja Krishnakumarsinhji Bhavnagar University (MKBU)* through Employment *Notification No. MKBU/ESTA/ADV/954/2025 dated 27 December 2025,* *Advertisement No. 107–12/2025.*
The connected matters were SCA Nos. 9212/2026, 9115/2026, 9217/2026, 9221/2026, 9300/2026, 9303/2026 and 9454/2026, with SCA No. 9212/2026 treated as the lead matter.
The lead case was Sinojiya Alpesh Devsibhai v. State of Gujarat & Ors.
The common judgment was delivered by Hon’ble Mr. Justice Niral R. Mehta.
The main issue before the Court was whether past teaching experience could be denied for the purpose of direct recruitment merely because the candidate had not been drawing salary in the prescribed UGC pay scale.
The High Court held that the petitioners were entitled to the benefit of Regulation 10(b) of the UGC Regulations, 2018 for counting their past teaching experience.
The Court specifically observed that a condition which has been expressly incorporated in Regulation 10(f)(iii) cannot be imported into Regulation 10(b) merely by way of interpretation.
Therefore, past teaching experience cannot be rejected only on the ground that the teacher was not receiving salary strictly as per the UGC pay scale, provided the experience otherwise satisfies the requirements of Regulation 10(b).
This principle is also significant for teachers who have worked as Temporary Assistant Professors or on contractual terms in State Universities and other recognised institutions. Merely because the appointment was temporary, contractual, fixed-pay or not carrying the full UGC pay scale does not, by itself, mean that the teaching experience becomes invalid for direct recruitment.
However, the experience must otherwise satisfy the relevant requirements regarding the nature of appointment, qualifications, duties, workload, institutional recognition or approval, and other applicable conditions under the UGC Regulations.
The Court allowed all the connected petitions and directed the respondent authorities, including Maharaja Krishnakumarsinhji Bhavnagar University, to treat the petitioners as eligible for the benefit of Regulation 10(b), re-evaluate their candidature, award appropriate marks for their past teaching experience and revise the merit particulars accordingly.
In simple words:
If a person has genuinely worked as a teacher or Assistant Professor in a recognised institution, including as a Temporary Assistant Professor or on contractual terms in a State University, the experience cannot be denied merely because the salary was not exactly as per the UGC pay scale. If the other conditions of Regulation 10(b) are fulfilled, such experience has to be considered for direct recruitment.
This is therefore an important judgment for Temporary Assistant Professors, contractual faculty members and teachers working in self-financed institutions whose past experience may earlier have been denied only because of the nature of their salary or appointment.
