የአደጋ ደኅንነት መስፈርቶችን ባላሟሉ አካላት የገንዘብና የሥራ ፈቃድን እስከማሳገድ ቅጣትን የሚደነግግ ደንብ ማውጣቱን የአዲስ አበባ ከተማ አስተዳደር እሳትና ስጋት ሥራ አመራር አስታወቀ።
ቲክቫህ ኢትዮጵያ የተመለከተው ደንቡ፣ “ማንኛውም ሰው በተቋሙ አስፈላጊ የአደጋ ደኅንነት መስፈርቶች ሳያሟላ የቀረ እንደሆነ እንደ ደረጃው ከ10 ሺሕ ያላነሰና ከ100 ሺሕ ያልበለጠ የገንዘብ ቅጣት ይጣልበታል” ይላል።
በኮሚሽኑ ደንብ መሠረት፦
ደንቡ፣ የህንፃዎችና የግንባታዎች ዲዛይን፣ ስለህንፃ፣ ግንባታና የግንባታ ሂደት መሟላት ያለባቸው የአደጋ ስጋት ደኅንነት መስፈርቶችንና የህንፃ አጠቃቀምን የተመለከቱ ግዴታዎችን አካቶ ይዟል።
የህንፃዎች ዲዛይን የሌሎች ሰዎችን ንብረቶች ለአደጋ በሚያጋልጥ መልኩ መሆን እንደሌለባቸው፣ በዲዛይኑ የእሳትና ሌሎች አደጋዎችን መከላከያና መቆጣጠሪያ መስፈርቶች መሟላት እንዳለባቸውም ደንቡ ያትታል።
ነባር ህንፃዎች ጥገና ወይም ለውጥ በሚደረግባቸው ጊዜ አደጋን ለመቆጣጠር/ለመከላከል የተገጠሙ ሲስተሞች ስለመሟላታቸው ፍተሻ ተደርጎ የአደጋ ደኅንነት ማረጋገጫ ምስክር ወረቀት መውሰድ ግዴታ መሆኑ ተመልክቷል።
በግንባታ ሂደት ያለ ህንፃ ሲጠናቀቅ በከፊል ወይም ሙሉ በሙሉ ለሚያዙ ክፍሎች አስፈላጊ የደኅንነት ተግባራት መሟላታቸው ካልተረጋገጠ ለተጠቃሚዎች መተላለፍ እንደማይችልም በድንጋጌው ተጠቅሷል።
ህንፃ ተከራዮች አደጋን አስቀድሞ ለመከላከል ወይም ለመቆጣጠር የሚያስችሉ የአደጋ ደኀንነት መስፈርቶችን እንዲያሟሉ፣ የአደጋ ደኅንነት መስፈርቶችን ያላሟላ ነባር ህንፃ ባለቤት ለማሟላት የሚጠበቅበትን የማድረግ ግዴታ እንዳለበት በደንቡ ተገልጿል።
“ማንኛውም የጅምር ህንፃ ተጠቃሚ ከሚመለከተው አካል የመጠቀሚያ ፈቃድ መያዝ ይኖርበታል”ም ብሏል ደንቡ።
በተጨማሪም፣ አደገኛ ንጥረ ነገሮች የሚያከማቹ የሚያጎጉዙ፣ የሚጠቀሙ የደኀንነት የደኅንነት ብቃት ማረጋገጫ ሊኖራቸው እንደሚገባ፣ ኮሚሽኑ የተከማቹ አደገኛ ንጥረ ነገሮችን እንደሚያስወግድ አትቷል።
እንዲሁም የተከለከሉ ድርጊቶችን ዝርዝር ያስቀመጠው ደንቡ የንግድ/የሥራ ፈቃድ እስከማሳገድ የሚደርስ እርምጃ እንደሚያስወስድ ገልጾ፣ እርምጃ አወሳሰድና አስተዳደራዊ ቅጣት ዝርዝር ድንጋጌዎችን ደንቡ አስቀምጧል።
ኮሚሽኑ ይህንኑ ደንብና ለማህበረሰቡ ሊቀርብ ስለሚገባ ግንዛቤ በተመለከተ ከሚዲያ ተቋማት የምክክር መድረክ ትላንት በሳሬም ሆቴል ያካሄደ ሲሆን፣ ተጨማሪ ይኖረናል።

ከመንግሥት ጋር ከተያያዙ ተግዳሮቶች ባሻገር ተቋራጮች በራሳቸው ደካማ የሆነ የውል አስተዳደር (Contract Administration) ትግበራ እንዳላቸውም ተጠቅሷል።
ሳሙኤል (ኢንጂነር)፣ ‹‹ለምሳሌ የዋጋ ማስተካከያ ይፈቀድልን በሚል ገንዘብ ሚኒስቴር ሲጠየቅ፣ ‹ማን ከለከላችሁ?› የሚል ጥያቄ ሲያነሳ፣ የከለከለን አማካሪው በልዩ ሁኔታ (Special Condition) በማስፈረም መሆኑን ሲገልጹ፣ ገንዘብ ሚኒስቴር እንደዚህ ያለ ውል ማን ፈርሙ አላችሁ? ብሎናል። የእኛንም ችግር ራሳችን መውሰድ መቻል አለብን። ግን ፍፁም የተከለከለ አይደለም። በፊት የ12 ወር ተባለ አሁን የ18 ወር ሆነ፣ ከዚያ ውጪ ግን ሙሉ ለሙሉ ይህ ፕሮጀክት ይህንን አያካትትም ብሎ መከልከልን ያመጣው በደካማ ውል አስተዳደር ትግበራችን ችግር ነው፤›› ብለዋል።
ከዚህ ባሻገር የአገር ውስጥ የሥራ ተቋራጮች የግንባታ ጥሬ ዕቃ ከውጭ አገሮች ለማስመጣት፣ ከፕሮጀክቱ አጠቃላይ ወጪ ከ40 እስከ 60 በመቶ የሚሆነውን ያህል ገንዘብ የሚያወጡ ቢሆንም፣ ግዥ ለመፈጸም የሚዋዋሉት አገር ውስጥ ካለ አስመጪ ድርጅት ጋር በመሆኑ፣ ዕቃዎቹ ወደ አገር ውስጥ የሚገባበት ጊዜ ፍጥነት አስተማማኝ አለመሆኑን ጥናቶቹን ያቀረቡት ባለሙያዎች አስረድተዋል።

በፌደራል መንግስት እና የአዲስ አበባ ከተማ አስተዳደር የመንግስት ግዥ መመሪያዎች ላይ ከተቀመጡ መሰረታዊ ጉዳዮች መካከል በግንባታ ግዥ ጨረታ ውድድር ላይ የስራ ልምዱ እና ዓመታዊ ተርን ኦቨር ላይ በዶላር ምንዛሬ ለውጥ መሰረት የሚደረግ ማስተካከያ መኖሩ ሲሆን ይህም እንደሚከተለው ይሰላል።
1) ለጨረታ ግምገማ ዓላማ የሥራ ተቋራጩ በስራ ልምድነት እንዲያዝለት በሚያቀርበው የግንባታ ውለታ ዋጋ ላይ ማስተካከያ የሚደረግለት ሲሆን ይህም የሚሰላው ጨረታ ከሚቀርብበት የመጨረሻ ቀን 28 ቀናት በፊት የነበረው የምንዛሪ ምጣኔን ውሉ በተፈረመበት ጊዜ በነበረው የምንዛሪ ምጣኔ በማካፈል ከተሰላ በኋላ በሚገኘው ውጤት በማባዛት ነው።
2)በተመሳሳይም በጨረታ ግምገማ ጊዜ ለሚደረግ ማስተካከያ አላማ ለተርን ኦቨር ስሌት የሚወስደው ሥራ ተቋራጩ ያቀረበው አመታዊ የግንባታ ሥራ ተርን ኦቨር መጠን' ጨረታ ከሚቀርብበት የመጨረሻ ቀን 28 ቀን በፊት የነበረውን የምንዛሪ መጠን በእያንዳንዱ በጀት አመት የመጨረሻ ቀን ላይ ባለው የምንዛሪ መጠን በማካፈል ነው።
3) ሁለቱም ማስተካከያዎች የሚሰሉት የኢትዮዽያ ብሔራዊ ባንክ የሚሰጠውን የውጭ አገር ገንዘብ መሸጫ ዋጋ መረጃ መሠረት በማድረግ ይሆናል።
