The claim that Ibn Majah's Sunan only has a single fabricated hadith* is not just inaccurate, but if fused liberally with the principle that weak hadiths can be cited for meritorious deeds, it can be incorrectly used to make many of the book's corpus of extremely weak and baseless reports admissible as proof. This claim actually goes against the objective of Imam Ibn Majah himself, who intentionally placed many fabricated and munkar hadiths in his book. As Shaykh Hamad al-Surayh and others note, in many places Ibn Majah subtly recorded a hadith with a worthless or fabricated chain to indicate its non-admissability as evidence. * which, in the view of the Shaykh leading the hearing, is the hadith on the virtue of Qazwin.

To this effect, Abu Khaliyl Jadd Sylvester (may Allah have mercy upon him) also said regarding this report: "It is not part of Sunan at-Tirmithi, he does not narrate from the Shaykh being narrated from in the chain, and, the chain is bonafide weak."

Imam al-Tirmidhi reports a narration in his Jami' where Imam Abu Hanifah is said to have wiped over his socks before his death by a few days. But using this riwayah of al-Tirmidhi is prima facie problematic for a number of reasons: 1. This report is not found in most manuscripts of al-Tirmidhi, as mentioned by Shakir, al-Arna'ut, and others; 2. Its chain contains Salih ibn Muhammad al-Tirmidhi, who was accused of lying; his reports are useless.

He replied that this interpretation was correct, but only partly so. According to Shah Wali Allah, Imam Abu Hanifah made an enormous contribution to Islam by providing rulings on countless legal issues. However, much of his work focused on specific legal cases and practical rulings rather than outlining the foundations and proof-texts from which such rulings are derived. Shah Wali Allah also noted that some versions of the hadith use the word rijal (“men”) instead of rajul (“a man”). This suggests that more than one Persian scholar may be included in its meaning. Thus, Shah Wali Allah argued that Imam Abu Hanifah could not be the only person intended by the hadith. He argued that Imam al-Bukhari, who was also of Persian ancestry and authored his monumental Sahih, should be counted as well.

فكرة النفور التام من الإسرائيليات في التفسير تضخمت كثيرا عند المعاصرين وبالغوا في النكير عليها رغم ما فيها من فوائد، وإن كانت ثانوية وليست مركزية في تفسير كتاب الله تعالى، لكنها تظلّ فوائد مهمة في باب الاستئناس والترجيح. وفي القرآن نفسه إشارات واضحة فتحتْ هذا الباب كقوله تعالى: {فَإِنْ كُنْتَ فِي شَكٍّ مِمَّا أَنزلْنَا إِلَيْكَ فَاسْأَلِ الَّذِينَ يَقْرَءُونَ الْكِتَابَ مِنْ قَبْلِكَ}، وقوله تعالى: {وَلَقَدْ آتَيْنَا مُوسَى تِسْعَ آيَاتٍ بَيِّنَاتٍ فَاسْأَلْ بَنِي إِسْرَائِيلَ}. فضلا عن الحديث المعروف "حدّثوا عن بني إسرائيل ولا حَرج" (أخرجه أحمد وأبو داود). ويعنيني على المستوى الشخصي جانب "الترجيح" و"الاستئناس"، أي أن تكون هذه الروايات على سبيل ترجيح تفسير على آخر، أو زيادة الاستئناس أو التوثيق لتفسير معيّن. وما ألاحظه أنّه كثيرًا ما يكون الأثر المرويّ عن بني إسرائيل مؤيّدًا لرأي الجمهور. وآخر دراساتي في الباب كانت حول تفسير الجمهور لقوله تعالى عن عيسى عليه السلام: {وَيُعَلِّمُهُ الْكِتَابَ وَالْحِكْمَةَ وَالتَّوْرَاةَ وَالإنْجِيلَ} (آل عمران: 48). فقد ذهب الجمهور إلى أنّ المقصود بالكتاب هو الكتابة أو الخطّ. وقد استهجن بعض الأعاجم المعاصرون (من الشحارير تحديدًا) هذا التفسير لجهلهم بالعربية، واستطالوا على الناس بهذا الذي حسبوه "غير معقول"! لكن بعيدًا عن ملاءمة قول الجمهور للعربية وللسياق الخاص والعام المتعلّق بعيسى عليه السلام وبالسورة، فقد وجدت ما يشهد لقول الجمهور من أقوال أهل الكتاب. لدينا أولا رواية عن سعيد بن جبير نقلها مفادها أن عيسى عليه السلام كان يعرف الأحرف الأبجدية قبل أن يعلّمه إيّاها معلّم الصبيان، بل قاله عنه ذلك المعلّم: "كيف أُعلّم من هو أعلم منّي"؟ وفي رواية أخرى عند ابن المنذر عن ابن إسحاق "فكان عند رجل من المكتبيين يعلّمه كما يعلّم الغلمان، ولا يذهب يعلّمه شيئا مما يعلمهم إلّا بَدَرَهُ على عِلْمه قبل أن يُعلّمه إيّاه". لكن المفاجأة كانت في ما يسمى "إنجيل الطفولة لتوما"، وهو إنجيل غير قانوني (أبوكريفي) يعود تاريخ كتابته إلى القرن الثاني الميلادي، وقد تفرّد عن جميع الأناجيل القانونية بقصة خلق الطير من الطين المذكورة في كتاب الله تعالى وهو أقدم مصدر بشري لها. وفيه أيضًا أنّ المعلم زكا أراد تعليم المسيح عليه السلام "الحروف الهجائية وكتب الحكمة" (تأمّل)، فيظهر أن المسيح قد تفوّق عليه وشرع في وصف الحروف وخطوطها وطريقة كتابتها. وقد وثق هذه القصّة أيضًا القديس إيرينيوس (130-202 م) في كتابه "ضدّ الهرطقات". والخلاصة أنّ دراسة الإسرائيليات مفيدة في هذا الباب وتنسجم مع توجيهات القرآن والرسول صلى الله عليه وسلّم التي ذكرتُها في أول المنشور. ومن أراد التوسّع في معنى كتاب عيسى وحكمته وسبب كون تفسير الجمهور هو التفسير الأقوى مع النقول الكاملة والمراجع فليقرأ دراستي حول الموضوع "كتاب عيسى وحكمته: دراسة في منهجية التفسير العلمي". رابط الدراسة: https://ghirascenter.org/2026/04/%d9%83%d8%aa%d8%a7%d8%a8-%d8%b9%d9%8a%d8%b3%d9%89-%d9%88%d8%ad%d9%83%d9%85%d8%aa%d9%87/

The problem with taking sadd al dhara’i (blocking the means) too far is that the places in which it is up for discussion in the shariah are usually gray areas since there are dhara’i that are to be blocked off by agreement, ones that are not considered by agreement, and a middle area where there’s room for disagreement. What causes the ulama to disagree in that middle area is that there are competing principles that can apply to the same issues. Each chapter of fiqh has its set of principles that govern what other principles should be used therefore we find in some areas there is more caution that must be taken and in other areas the correct thing to do is to be lenient. Al Qarafi states that just as these means must be closed sometimes there are times where it’s obligatory to open them. Therefore, it’s a mistake to believe that the best thing to always do is take the side of caution. Those who stress cautious practice of the deen in places where the shariah demands ease are not being scrupulous. If taking the side if caution was always the correct thing to do then one should never leave their house because by leaving the house one can get into an accident, come across music playing on the way, or see something they are not supposed to.

س) الشيخ القعيمي حفظه الله في الحواشي السابغات رجح أن مسافة القصر على المذهب 138 كيلو وقال لم أر أحدا يقول بهذه المسافة ، ثم رأيته رجح في كتابه الفوائد والتحريرات أنها 80 كيلو بناء على أن الميل 3500 ذراع ومن قدر الميل بـ 6000 ذراع ( الشافعية والحنابلة ) ما مستنده وحجته في هذا التقدير ؟ وأيهما يصح نسبته للمذهب بحيث نقول هذا هو المذهب عند المتاخرين؟ وكنت سمعت الشيخ أحمد زين العابدين يقول أن هذه المسألة من معضلات المذهب فما القول الفصل فيها ؟ ج) الصحيح ما ذكره الشيخ القعيمي في الفوائد والتحريرات، وهو بحث نفيس هو أعلى بحث في المذهب في هذا الباب اطلعت عليه، وهو أن المسافة لا تتجاوز ال 90 كيلو على أقصى تقدير التقدير ب6 آلاف ذراع غلط حسابي لا أكثر. ومنصوص مذهبنا يخالفه لأن منصوص الأصحاب أن جميع المواقيت بينها وبين مكة مسافة قصر ونحن نستدل على مسافة القصر بأثر ابن عباس في عسفان، وكل هذه بينها وبين مكة أقل من 100 كيلو وقطعًا أقل من 138 كليو أما نسبة ال 138 للمذهب فنسبة مبنية على مجرد الحساب بتحويل الذراع فقط والذراع قد وقع في تقديره غلط حسابي ظاهر أشار إليه ابن حجر وغيره. فالصحيح أن المسافة لا تتجاوزال 85 كيلو وهي تدور بين 80 و83 كيلو، فمن اراد الاحتياط جعلها 85 وهذا هو الصحيح الذي يصح نسبته للمذهب بناء على نصوص أحمد وعامة أصحابنا في مسألة القصر ومسألة المواقيت. ففي مسألة القصر استدلوا بأثر ابن عباس على مسافة القصر روي عن ابن عباس رضي الله عنه أنه قال: يا أهل مكة، لا تقصروا في أدنى من أربعة برد، ما بين عسفان إلى مكة، وكان ابن عباس رضي الله عنهما وابن عمر لا يقصران في أقل من أربعة برد، ولأنها مسافة تجمع مشقة السفر من الحل والشدة. اهـ من كلام الموفق ابن قدامة. وهو عمدة كل من جاء بعده من اصحابنا في الاستدلال بنفس الأثر وهو في الأصل استدلال الإمام أحمد وعمدته في الباب على ما نص عليه الإمام في مسائل الأثرم. قال الأثرم: قيل لأبي عبد الله: في كم تقصر الصلاة؟ قال: في أربعة برد. قيل له: مسيرة يوم تام؟ قال: لا، أربعة برد، ستة عشر فرسخا ومسيرة يومين، وذلك لما روى ابن عباس عن النبي صلى الله عليه وسلم قال: "يا أهل مكة لا تقصروا في أقل من أربعة برد من مكة إلى عسفان". وما بين مكة وعسفان أقل من 130 كيلو بلا شك اليوم تساوي حوالي 80 ومع اعتبار توسع العمران يعني أن البلدتين قديما كانتا أبعد فإنها ربما تزيد بمقدار 20 كيلو على اقصى تقدير، هذا على اعتبار ان التوسع العمراني له تأثير في اعتبار المسافة على ما نص عليه أصحابنا في اعتبار رخص السفر بمفارقة عامر القرية. ومن الممتنع أن نستدل بأثر على مسافة القصر ثم نجعل الترخص فيها ممنوعًا، فكأننا نقول دليل مسافة القصر هو أثر ابن عباس وهو دال على 80 كيلو لكن لا يجوز القصر في 80 كيلو بل لابد من 138 هذا خلف في الاستدلال. والثاني أن أصحابنا نصوا (كما في شرح العمدة لابن تيمية وفي الشرح الكبير والمغني وغيرها) أن جميع المواقيت على مسافة قصر من مكة، ونحن نعلم أن بين بعض المواقيت وبين مكة ما هو أقل من مسافة 138 كيلو بلا شك أيضًا، فإن بين قرن المنازل (السيل الكبير ميقات أهل نجد) وبين مكة اليوم حوالي 75 كيلو، ومع التوسع في العمران الحادث فإن المسافة ربما تزيد في القديم على هذا شيئًا ما لكنها لن تصل بأي حال إلى 138 وكذلك في ذات عرق فبينها وبين مكة حوالي 90 كيلو. وعلى كل حال فإن كلام الإمام أحمد وكلام أصحابنا إذا ضم بعضه إلى بعض = ظهر أن ما في تقدير من قد الميل بـ 6 آلاف ذراع خطأ حسابي لا يتماشى مع باقي كلام الإمام والحنابلة في سائر الأبواب إلا على نوع تأول عسر لا يخلو من تكلف. فالأظهر والله أعلم أن مسافة القصر تقريب لا تحديد = وسبب التقريب التفاوت الذي رأيت في تقدير المسافة أولًا وتحويل القياسات إلى كيلوات، وبسبب أن تقدير مسافة القصر في المذهب معتمده على نصوص فيها حساب مسافة بين بلدين، وتقدير المسافة بين بلدين مبني على حال العمران فيهما كما لا يخفى، وحال العمران يختلف ويتفاوت من زمان لزمان، وقد اتسع العمران في مكة بالذات بشكل ضخم عما سبق. وهذا يجعل تقدير المسافة بين مكة وعسفان في زماننا ربما يختلف عنه في زمان ابن عباس رضي الله عنه. وفي الجملة فإنها تقريب لا تحديد وهي تدور بين 80 إلى 85 أو 90 على أقصى تقدير فيما أرى، فالاحتياط أن من سافر مسافة 80 فلا يترخص احتياطًا وإن ترخص فلا أرى عليه حرجًا وليس خارجًا عن المذهب بالكلية. والاولى أن لا يقصر إلا إن بلغت مسافة سفره 85 وبالله التوفيق. #أجوبة_اللجنة_العلمية #معهد_البهوتي
