In 2023, the Florida state legislature passed a law that makes it criminal trespassing for a transgender person to refuse to leave a bathroom that does not align with their sex assigned at birth. Rheintgen spent about 24 hours in custody. She faces misdemeanor charges and is due in court next month. If convicted, she could be sentenced to up to two months in jail and a $500 fine. According to the Movement Advancement Project, which tracks anti-LGBTQ+ policy, a quarter of the nation’s transgender Americans live in states with anti-trans bathrooms bans. Nineteen bar transgender people from using bathrooms in some form that align with their gender in government buildings or schools. Two (Florida and Utah) make it a criminal offense. Rheintgen suggested to the Associated Press that she was not sorry for her protest. “I wanted people to see the absurdity of this law in practice,” she said. “If I’m a criminal, it’s going to be so hard for me to live a normal life, all because I washed my hands. Marcy Rheintgen, 20, is believed to be the first trans person arrested for violating an anti-trans bathroom law in the country. Rheintgen, who was visiting her grandparents in Florida, reportedly entered the women’s room at the state capitol building in Tallahassee on March 19 after telling officers she was there “to break the law.” She told the New York Times that she was inside the restroom for 30 seconds to a minute.
