I invoke this principle not as an automatic exemption from motor-vehicle licensing but as an analytical limitation on coercive administrative requirements. Where a regulatory condition requires surrender of an independently protected constitutional right, the government cannot evade constitutional scrutiny by describing the activity as a privilege. The label assigned by an administrative agency cannot resolve the constitutional question. The substance of the governmental burden must be examined. IX. THE CONSTITUTIONAL QUESTION THAT DESERVES RECONSIDERATION I recognize that Hendrick v. Maryland, 235 U.S. 610 (1915), Kane v. New Jersey, 242 U.S. 160 (1916), and Miller v. Reed, 176 F.3d 1202 (9th Cir. 1999), presently impose substantial barriers to a categorical argument that private motor-vehicle operation is exempt from licensing. But I distinguish between acknowledging existing precedent and conceding that every constitutional question arising from that precedent has been resolved beyond reconsideration. I present a question of constitutional principle: To what extent may a State condition an individual's peaceful, private, noncommercial exercise of locomotion upon prior administrative permission, when the individual has engaged in no demonstrated dangerous conduct, and when the public ways are expressly established for vehicular travel as a matter of right? The accompanying inquiry is whether the resulting regulatory framework remains a legitimate safety measure or imposes burdens upon freedom, privacy, economic participation, and personal autonomy that warrant additional constitutional examination. These questions should be evaluated through the actual constitutional provisions, the precise statutory scheme, the evidentiary record, applicable precedent, and the real-world operation of governmental power. X. DECLARATION OF PRINCIPLE I maintain that the people are inherently free. I maintain that their liberties do not originate in legislatures, agencies, departments, or licensing officers. I maintain that the sovereignty of the people precedes the authority of the institutions created to serve them. I recognize the necessity of maintaining safe highways, protecting life and property, and requiring accountability for wrongful conduct. But I reject the proposition that government should treat every peaceful member of society as presumptively unauthorized until administrative permission has been obtained. The exercise of a fundamental liberty should not be confused with the commercial exploitation of a public resource, nor should government's power to regulate be mistaken for ownership of the liberties regulated. The burden of constitutional governance is not merely to demonstrate that a regulation has been enacted. It is to preserve the constitutional boundaries within which governmental authority may legitimately operate. The people did not create government so that government might become the proprietor of their freedom. They created government so that freedom might be secured. The preservation of that distinction is the constitutional responsibility of every public official, every court, and ultimately the people themselves.

A right which exists only after official permission risks becoming indistinguishable, in practical operation, from a revocable privilege. The central inquiry should be whether such a condition is constitutionally justified by the nature of the activity, the degree of governmental intrusion, the legitimate public interest, and the availability of less burdensome alternatives. VI. PUBLIC SAFETY IS LEGITIMATE; UNLIMITED REGULATORY AUTHORITY IS NOT I do not deny the legitimate governmental interest in protecting the public against dangerous highway conduct. A person exceeding lawful speeds, operating recklessly, disregarding traffic-control devices, endangering pedestrians, or otherwise violating valid safety requirements may properly be subjected to lawful enforcement. The freedom I advocate is not freedom to injure others. Nor is it freedom to disregard the equal rights of persons sharing the public highway. Rather, I maintain that the peaceful enjoyment of liberty should be the ordinary rule, with coercive governmental intervention directed toward genuine public-safety interests. This invites several fundamental inquiries: What demonstrable safety objective is served by a particular licensing requirement? To what extent does the requirement burden private liberty? Could the same objective be substantially achieved through enforcement of actual dangerous conduct, vehicle-safety standards, education, or other less restrictive measures? What consequences arise when the licensing system itself operates as a means of economic exclusion, administrative punishment, or intrusive governmental identification? Has the regulatory burden remained reasonably connected to safety, or has the licensing apparatus expanded into broader administrative control? I recognize that current constitutional precedent permits preventive safety regulation and does not universally require an observed traffic violation before imposing licensing obligations. Nevertheless, I contend that the existence of that precedent should not foreclose public debate, legislative reform, or carefully developed constitutional challenges addressing the scope of governmental authority. A legitimate police power is not necessarily an unlimited police power. VII. PRIVACY, IDENTIFICATION, AND THE RIGHT TO BE LET ALONE Compulsory licensing presents constitutional concerns extending beyond the administrative act of acquiring permission. Modern licensing systems may require disclosure of identifying information, continuing database registration, documentary verification, and interaction with government systems. When coupled with automated license-plate readers, electronic recordkeeping, and pervasive surveillance infrastructure, the consequences for personal privacy warrant independent constitutional examination. The Fourth Amendment does not cease protecting an individual merely because that person enters a public highway. In Delaware v. Prouse, 440 U.S. 648 (1979), the Supreme Court held that an officer ordinarily could not arbitrarily stop an automobile solely to inspect driving credentials and registration absent reasonable suspicion or another constitutionally sufficient basis. The significance of that decision is fundamental: the existence of governmental licensing authority does not automatically extinguish constitutional protections against unreasonable seizures. Likewise, Washington Constitution Article I, Section 7 expressly protects private affairs against disturbance without authority of law. I therefore maintain that the constitutionality of identification demands, retention of personal information, vehicle surveillance, and discretionary investigative encounters must be examined independently from the State's general authority to regulate highway safety. Licensing does not furnish government with unlimited investigative authority over the person. VIII. NO CONSTITUTIONAL RIGHT SHOULD BE INDIRECTLY EXTINGUISHED THROUGH ADMINISTRATIVE CONDITIONS In Frost & Frost Trucking Co. v. Railroad Commission, 271 U.S.

140 (1924), the Supreme Court recognized the distinction between ordinary private highway use and the extraordinary use of public highways for gain. In Stephenson v. Binford, 287 U.S. 251 (1932), the Court likewise described private highway purposes as primary and preferred relative to commercial uses. I do not contend that these decisions themselves invalidate general licensing requirements. Rather, I invoke their distinction between the ordinary enjoyment of public ways and their special commercial exploitation. I maintain that this distinction deserves renewed constitutional examination when statutes impose compulsory licensing upon an individual engaged exclusively in peaceful, private, noncommercial movement. The public character of the highway should create a substantial presumption in favor of meaningful public access. IV. THE PRIVATE PLEASURE AUTOMOBILE AND THE COMMERCIAL CARRIER Historically, legal authorities have distinguished automobiles used for personal enjoyment and transportation from vehicles engaged in commercial transportation. In American Mutual Liability Insurance Co. v. Chaput, 95 N.H. 200 (1948), the court identified the ordinary automobile with the historical concept of a pleasure vehicle. Private locomotion may therefore be distinguished, as a matter of factual purpose, from transportation undertaken for hire, carriage of passengers for compensation, or the operation of a commercial transportation enterprise. The distinction is not that an automobile ceases to be mechanically propelled when operated privately. Nor does its private purpose automatically exclude it from the statutory definition of a motor vehicle. The distinction concerns the character of the activity. An individual transporting family members, visiting a neighbor, attending worship, accessing medical care, or traveling for personal enjoyment is not, merely by that conduct, undertaking the commercial enterprise of a carrier for hire. Where a statute expressly regulates commercial carriage, the State must establish the statutory elements that bring the individual within that enactment. The Whole-Act Rule demands that statutory provisions be interpreted in context, including their definitions, limitations, qualifications, and exemptions. I maintain that commercial regulatory obligations must not be extended to private conduct through administrative assumption, disregard of statutory definitions, or the substitution of a broader legal category for a narrower one enacted by the Legislature. V. COMPULSORY LICENSING AND THE PROBLEM OF CIVIL SUBORDINATION Here lies my fundamental objection. When government declares that an individual may not undertake an otherwise peaceful and ordinary activity without first obtaining governmental permission, the relationship between citizen and State is fundamentally altered. The individual is no longer treated as presumptively free to act responsibly. Instead, freedom becomes administratively conditional. The individual must apply, disclose information, satisfy governmental criteria, submit to fees, and remain subject to administrative restrictions before exercising the activity. To my understanding, this presents a form of civil subordination profoundly inconsistent with the philosophical foundations of a free society. I characterize this condition as possessing attributes of servitude—not because every licensing requirement constitutes slavery within the technical meaning of the Thirteenth Amendment, but because compulsory permission can subordinate individual autonomy to continuing governmental control. The distinction between these propositions is legally important. My objection is to compulsory dependence upon governmental authorization, not an assertion that licensing constitutes forced labor. The ultimate constitutional concern is whether government has transformed the protection of liberty into an apparatus through which liberty is first withheld and subsequently granted upon prescribed conditions.

IF I am WRONG, Tell me in the comments: THE INALIENABLE RIGHT OF PRIVATE LOCOMOTION A Constitutional Declaration Concerning Natural Liberty, Governmental Compulsion, the Public Highways, and the Limits of the Police Power I. THE RIGHTS OF THE PEOPLE PRECEDE THE EXISTENCE OF GOVERNMENT I begin with the foundational proposition upon which the American constitutional system was established: mankind possesses certain natural and inalienable rights that neither originate with government nor depend upon its permission for their existence. The Declaration of Independence recognizes that all men are created equal and endowed by their Creator with certain unalienable rights, including Life, Liberty, and the pursuit of Happiness. Governments are instituted among men to secure those rights, deriving their just powers from the consent of the governed. The significance of that declaration cannot be understated. Government is the creation. The people are its authors. An institution brought into existence to secure liberty cannot legitimately claim that the very liberty it was instituted to protect exists solely through its administrative permission. This principle finds additional expression in Article I, Section 1 of the Oregon Constitution, which recognizes the inherent political authority of the people and the establishment of governments for their peace, safety, and happiness. Likewise, Article I, Section 1 of the Washington Constitution declares that political power is inherent in the people and that governments exist to protect and maintain individual rights. Therefore, I contend that the constitutional inquiry must begin not with whether an individual has received governmental permission to move about peacefully, but with whether government possesses constitutionally sufficient justification to burden that movement. II. PRIVATE LOCOMOTION IS AN INCIDENT OF NATURAL LIBERTY The freedom to move one's person from one place to another is an indispensable incident of personal liberty. Without meaningful freedom of movement, an individual cannot fully exercise freedom of association, pursue employment, provide for family, access the courts, practice religion, acquire necessities, or participate in civil society. The Supreme Court has long acknowledged the constitutional significance of freedom of travel. In Kent v. Dulles, 357 U.S. 116 (1958), the Court recognized freedom of movement as part of the liberty secured by due process. In Shapiro v. Thompson, 394 U.S. 618 (1969), and Saenz v. Roe, 526 U.S. 489 (1999), the Court reaffirmed constitutional protection for interstate travel. I submit that the substantive liberty underlying these decisions deserves examination beyond the artificial simplicity of asking whether an individual may theoretically move by some other means. A right must be evaluated according to its meaningful exercise. A government may preserve the abstract language of liberty while imposing practical conditions that substantially impair its enjoyment. Accordingly, the question I advance is whether the peaceful use of one's privately owned automobile upon highways established for public vehicular travel should be presumptively protected as an ordinary incident of personal liberty, subject to constitutionally justified safety limitations. III. PUBLIC HIGHWAYS ARE ESTABLISHED FOR PUBLIC USE AS A MATTER OF RIGHT The statutory language itself deserves careful examination. Oregon Revised Statutes § 801.305 recognizes public highways as ways open, used, or intended for general public vehicular travel as a matter of right. Washington Revised Code § 47.04.010(13) similarly recognizes highways open as a matter of right to public vehicular travel. This language reflects a historical distinction of substantial constitutional importance. A public highway is not ordinarily the private property of a licensing officer, nor is its public character contingent upon the discretionary favor of an administrative department. The California Penal Code classifies two types of officers: 1) Code Enforcement Officer 2) Peace Officer First, Code Enforcement Officers. The California Government Code defines a "code" as any statute, or any published compilation of rules, regulations or standards adopted by by State and Federal agencies...in other words, these are rules ONLY for State and Federal agencies and agents. With that in mind, a code enforcement officer's role is to police State and Federal agencies and ensure that these agents strictly adhere to the codes that their agencies adopt. Now Peace Officers. As established under Article II, Section 1 of the California Constitution, a Peace Officer's role is to secure and protect the people, their rights, their properties, and their political powers. The benefit of security and protection is peace...thus they are called peace keepers. Conclusion, the relationship of uniformed officers to their fellow officers is that of a code enforcement officer. The relationship of uniformed officers to the people (their superiors) is that of peace officers. Breach of duty and treason begins when uniform officers act as code enforcement officers over the people under color of office, color of authority, and color of law.
