I handled defamation cases for falsely accused clients for over 26 years. I handled such cases on a contingency fee basis (a percentage of the recovery) and the ethics rules allowed the attorney to advance case expenses. As a result, I chose my cases and clients carefully. And then I worked hard to achieve successful results for my clients. This was the same fee and expense arrangement in the cases I handled for Nicholas Sandmann until I was fired. Fortunately for Nicholas, I successfully resolved defamation cases for him against CNN and The Washington Post before I was terminated. Although he was a novice in defamation law, Todd McMurtry assisted me on those cases under the same contingency fee and expense arrangement. I felt that I was helping Todd learn how to handle defamation cases and he was always grateful and appreciative of my efforts. Then as I said, I was suddenly fired. Todd and Nicholas refused to offer me one thin dime for the significant efforts I had made on Nicholas’ remaining 6 cases (which I had filed for him and in which I had successfully postured the cases to defeat defense motions to dismiss). Oh well, practicing law was never about money for me. It was about my clients. Of course if my clients did well in the cases, I was fairly compensated. A Win-Win. From the text message below received from a friend today, it appears that Todd has now taken a different approach to fees and expenses in his representation of Kyle Rittenhouse. Todd and Nicholas have apparently teamed up with Kyle to fundraise from the public to finance fees and expenses in Kyle’s defamation cases. Will the donors receive any portion of the proceeds from those cases??? Will they have any control over how the donations are spent???Will there be transparency and an accounting for the receipt of those funds and all expenditures???
