Know the Law: Types of Bail in Criminal Law Bail is a legal mechanism that allows an accused person to remain free while a criminal case is pending, subject to certain conditions. It is based on the principle that a person is presumed innocent until proven guilty. 1. Regular Bail Granted to a person who has already been arrested and is in police or judicial custody. It allows the accused to be released while the trial continues. 2. Anticipatory Bail A pre-arrest bail granted when a person reasonably fears that they may be arrested for a non-bailable offence. If the police attempt to arrest them, they are released on the strength of the court's order. 3. Interim Bail A temporary bail granted for a short period, usually until the court decides the main bail application. It ensures that the accused is not arrested or remains released during that period. 4. Default (Statutory) Bail If the investigating agency fails to file the charge sheet within the time prescribed by law (generally 60 or 90 days, depending on the offence), the accused becomes entitled to bail, provided the legal requirements are fulfilled. Bail is a safeguard of personal liberty, but it is never automatic. Courts consider factors such as the seriousness of the offence, the possibility of the accused fleeing, influencing witnesses, or tampering with evidence before granting bail. The Law Project
