State unlawfully trying to make BEE a prerequisite for air services licenses The Air Services Licensing Council (ASLC) is unlawfully making air services licenses conditional upon race criteria. The ASLC is threatening to withhold air services licenses from aviation business owners too white for its liking. Sakeliga today urgently demanded that the ASLC immediately stops this process and returns to the application strictly of only the criteria for which it is lawfully empowered, namely those concerning operations, safety and accountability. The ASLC is acting ultra vires, unconstitutionally and unlawfully. The ASLC is currently placing applicants and holders of air services licences under pressure to indicate their ‘commitment to transformation’ and ‘increasing their promise of participation in B-BBEE’, before they are to be awarded licenses. There exists no basis in legislation to make race, transformation or B-BBEE a prerequisite for air services licenses. All the relevant legislation, like the Air Services Licensing Act (115 of 1990), focus on safety and accountability. This unlawful and unacceptable state interference harms companies and their shareholders, employees and clients, as well as the local aviation industry as a whole. Data from the Timeline feature in Google Maps, which is controlled by the Location History setting and keeps a record of routes and trips users have taken, will soon be stored directly on users' devices instead of by Google. That means Google itself will no longer have access to user location history data. Be clear South Africa, the window to contest the NHI Bill is closing fast The goal of providing universal healthcare is laudable. In more ideal circumstances South Africa would be able to implement relevant, appropriate legislation, and perhaps more importantly, governance reforms, to achieve this goal. Policymakers cannot ignore our reality, and neither should Parliament. The ideal circumstances needed are unfortunately not our South African reality, and the National Health Insurance (NHI) Bill is not the appropriate vehicle to achieve universal care in any case. Despite our context being painfully apparent, the NHI Bill has recently been pushed through Parliament’s National Council of Provinces (Ncop) without a single amendment. That the Bill was passed in this manner, even though it attracted fierce opposition and public critiques, unfortunately, points to a legislative process which has been wholly deficient given the grave consequences that the legislation heralds for the country. The NHI’s pilot projects, which ran between 2012 and 2017, were meant to lay the foundations for its implementation. They are widely regarded as having failed.
