Pharmacia & Upjohn was excluded from Medicare/Medicaid, but since it sold nothing, the impact was minimal and Pfizer was able to keep its contracts with the federal government as a result. In the 2009 record-setting settlement, Pfizer paid $2.3 BILLION total: $1.3 billion in criminal fines, the largest ever at the time. $1 billion civil for illegally promoting painkillers not approved by the FDA. Even the biggest fines in history equaled just 3 months of profit for Pfizer because not only are they too big to fail, they're too big to jail.
