*🛡️Retired Judge*
♟️At any time, the chief justice of India can request a retired judge of the Supreme Court or a retired judge of a high court (who is duly qualified for appointment as a judge of the Supreme Court) to act as a judge of the Supreme Court for a temporary period.
♟️He can do so only with the previous consent of the president and also of the person to be so appointed.
♟️Such a judge is entitled to such allowances as the president may determine.
♟️He will also enjoy all the jurisdiction, powers and privileges of a judge of Supreme Court. But, he will not otherwise be deemed to be a judge of the Supreme Court.

| 3 | *State of WB V. Jai Hind Pvt Ltd (2026 SC)*
Facts:
1. S.57A of the WBEA Act, 1953 provides that, “The State government may by order invest any authority with all the powers of a civil court under CPC”.
2. The State of WB, in exercise of its power u/S.57A vested the Revenue Authorities with all the powers of a civil court under CPC.
3. The issue before the SC is: whether the Revenue Authorities can Review its own orders?
SC held that:
1. The power of review is *not an inherent power* of the Court. It must be conferred by law either specifically or by necessary implication. The quasijudicial authorities can exercise only those powers which are expressly conferred upon them by the statute. Hence, the power of review, which is not inherent, must be conferred upon the quasi-judicial authority by means of a *specific provision in the statute*.
2. Unless a specific statutory provision invests the power of Review in the Revenue Authorities, these authorities could not have possessed the power or authority to review an earlier order. The omnibus expression used i.e. “all the powers of the Civil Court”, does not amount to conferment of power of review as well to these authorities.
3. At a more fundamental level, in the absence of an express legislative mandate, allowing a Revenue Officer to review its own concluded quasi-judicial order would trench upon the constitutional doctrine of separation of powers, which constitutes part of the basic structure of the Constitution. Though vested with limited adjudicatory functions, authorities under the WBEA Act, 1953, remain essentially members of the executive branch and are neither part of the judicial organ nor equipped with the institutional safeguards that attend judicial office, such as independence from executive control. | 51 |

| 5 | *🛡️Directive Principles Of State policy DPSP*
♟️The constitution of India aims to establish not only political democracy but also socioeconomic justice to the people to establish a welfare state.
♟️These provisions are given in Part IV of Indian Constitution.
♟️Directive Principles of state policy are in the form of instructions to the governments at the centre as well as states.
♟️Though these principles are non justiciable, they are fundamental in the governance of the country.
♟️The idea of the Directive Principles of State Policy has been taken from the
Irish Republic .
♟️The Directive Principles of State policy were incorporated in our constitution in order to provide economic justice and to avoid concentration of wealth in the hands of few people.
♟️The constitution covers from Article 36 to 51 as Directive Principles of State
Policy.
♟️They are unique blend of socialistic, liberal, democratic and Gandhian Principles.
♟️They describe as the ‘conscience of the constitution’.

3-year practice rule upheld: Supreme Court refused to reconsider the fundamental requirement of prior legal experience before entering judicial service.
Transition period: Candidates applying under notifications issued from May 25, 2025 to March 31, 2027 can apply without prior practice.
Deemed 1-year practice: Such candidates will be deemed to have completed 1 year of active practice and need not produce a practice certificate for that period.
After selection: They will be appointed as Trainee Judicial Officers.
1-year Judicial Academy training: They must undergo 1 year of intensive training at the concerned State Judicial Academy.
1-year clerkship: After training, they must complete 1 year of structured law clerkship:
6 months under the Principal District Judge / Higher Judicial Service.
6 months under sitting judges of the concerned High Court.
Evaluation: A High Court judge supervising the trainee will submit a reasoned evaluation report on progress and suitability.
Regular appointment: On satisfactory evaluation, the trainee will be appointed to the regular post and receive regular pay and service benefits.
From April 1, 2027: Candidates must have at least 1 year of active legal practice to appear for Civil Judge (Junior Division) examinations.
Practice verification: The 1-year practice must be supported by a certificate of practice, based on recorded presence and participation in effective judicial proceedings.
Training after April 1, 2027: Selected candidates will still undergo:
1 year Judicial Academy training
6 months clerkship under District & Sessions Judge / Higher Judicial Service
6 months clerkship under a sitting High Court judge
Training remuneration: During training, Trainee Judicial Officers will receive 50% of the gross remuneration payable to a Judicial Magistrate First Class.
Reason for limited relaxation: Court held that sudden restoration of the 3-year rule, without transitional arrangements, caused hardship to young lawyers and law graduates.
Core reasoning retained: Court maintained that exposure to the legal profession before joining the judiciary has a reasonable nexus with judicial service.
Important: The Court did not reconsider the requirement of prior legal experience; it only provided a limited transitional arrangement.
