How this controversy evolved? Ans:- It is not that Maharashtra legislative assembly had not elected speaker since from the establishment of the government. Earlier, the Speaker was from congress party who has resigned and thereafter there was no elected speaker and all the proceedings of the house was being run by Deputy Speaker. Then oppostion party(BJP) started asking for election of Speaker and this mesage has been sent by Governor to the CM who has implicitely denied and said election will be done on proper time. The major question is :- Why is the approval of the Governor required to elect the Speaker of the Assembly? Article 178 of the Constitution states: “Every Legislative Assembly of a State shall, as soon as may be, choose two members of the Assembly to be respectively Speaker and Deputy Speaker thereof and, so often as the office of Speaker or Deputy Speaker becomes vacant, the Assembly shall choose another member to be Speaker or Deputy Speaker, as the case may be.” The Constitution does not specify the process of holding these elections; that is left to the state legislatures. It also does not set a timeframe other than to say the elections should be held “as soon as may be”. Good Rules in some states:- UP:-Election of speaker must concluded within 15 days if the post falls vacant during the term of assembly. Harayana:- Election for he Post of speaker must be held as soon as possible after the assembly election, and the Deputy speaker must be elcted within 7 days. Maharashtra:- Maharashtra Legislative Assembly Rules, “The Governor shall fix a date for the holding of the election and the Secretary shall send to every member notice of the date so fixed. But recently the Govt brought an amendment in the rules which now says,The recommendation of CM is required for election of speaker.

For this, Firstly, we should know Seperation of Power that says there are segregation of functions between three organs of government.And none of the organ should not intervene into other domain and none should do the work of other, But In India, fist thing to understand is Seperation of power is not strict, there is functional overlapping and this is one of the reason of Conflict. Secondly, whatever judiciary pronounces, it is the duty of executive to implement, but here again conflict can be seen if there is overlapping of functions and executive denies to implement. The Provision was challenged in Kameshwar Singh vs. State of Bihar where Patna High Court held the Bihar Land Reforms Act unconstitutional as it violated Article 14 of the Constitution of India. Several other petitions challenged under Article 31 that provided the property right. The Nehru Government provided immunity to the act by introducing First Constitutional Amendment 1951. The amendment introduced the Ninth Schedule through Article 31B insulating the Act from any kind of judicial scrutiny. 🛑Confrontation between the Judiciary and the Executive worsened when Allahabad HC , set aside Indira Gandhi’s election to the Lok Sabha from Rae Bareli. Gandhi reacted to the judgment of June 12, 1975 by imposing Emergency. 🛑The Janata Party administration had impounded passport of Menaka Gandhi on the grounds of “in public interest”, which was challenged. The majority ruling of the Supreme Court declared that the right to travel abroad was part of right of personal liberty under Article 21 and government can’t arbitrarily impound the passport as it violated right to equality under Article 14. 🛑 Recently, Justice Deepak Gupta while speaking during his farewell said that Judges should strike down the executive action which is found unconstitutional. However, Attorney General of India K.K Venugopal put a contrary view on a similar issue. He said that Judiciary is over steeping in the domain of the executive by a frequent expansion of the fundamental rights by the Supreme Court through judicial legislation. 🛑Appointment of judges has been a conflicting issue since a long way back:- The year 2018 witnessed one of such bitter clashes when Law minister Ravi Shankar Prasad wrote a letter to the CJI Deepak Mishra segregating the recommendation of Supreme Court recommendation of appointing two judges to the Supreme Court. 🛑Even, the migrant labour crisis that happened recently is also a good example of a clash between the executive and judiciary. However, at first instance, the apex court had refused to entertain the issue referring to it as a part of the administrative policy to be exercised by the executive. However, the Andhra Pradesh and Madras High Court took a serious note on the matter issuing guidelines to the Central and State government to take necessary steps for the migrant labours.

The Provision was challenged in Kameshwar Singh vs. State of Bihar where Patna High Court held the Bihar Land Reforms Act unconstitutional as it violated Article 14 of the Constitution of India.
