✳️जीवनसाथी को लंबे समय तक यौन संबंध बनाने की अनुमति न देना मानसिक क्रूरता: इलाहाबाद हाईकोर्ट

🟧 इलाहाबाद हाईकोर्ट में तलाक से जुड़ा एक मामला आया। पति ने इस आधार पर पत्नी से तलाक की मांग की थी कि उसकी पत्नी लंबे समय से उसको उसके साथ यौन संबंध बनाने की अनुमति नहीं दे रही है। उसके साथ नहीं रह रही है।
🟫 हाईकोर्ट ने क्रूरता के आधार पर पति को पत्नी से तलाक लेने की अनुमति दी। और कहा कि पति या पत्नी की तरफ से लंबे समय तक अपने जीवनसाथी के साथ बिना पर्याप्त कारण के यौन संबंध बनाने की अनुमति न देना, अपने आप में मानसिक क्रूरता है।
🟥जस्टिस सुनीत कुमार और जस्टिस राजेंद्र कुमार-चतुर्थ की डिवीजन बेंच मामले की सुनवाई कर रही थी। पति की ओर से हिंदू मैरिज एक्ट, 1955 की धारा 13 के तहत तलाक याचिका फैमिली कोर्ट में दायर की गई थी। फैमिली कोर्ट ने याचिका खारिज कर दी थी।
🟦पति ने इसके खिलाफ हाईकोर्ट का रूख किया। तलाक के लिए पति ने क्या-क्या दलीलें पेश कीं वो भी जान लेते हैं। पति ने कहा कि दोनों की शादी 1979 में हुई। कुछ समय बाद, पत्नी का व्यवहार और आचरण बदल गया। उसने पत्नी की तरह उसके साथ रहने से इनकार कर दिया। समझाने के बावजूद उसने उससे कोई संबंध नहीं बनाया। वो उससे अलग अपने माता-पिता के घर में रहने लगी।
🟩 पति ने आगे कहा कि अपनी शादी के छह महीने बाद उसने पत्नी को वैवाहिक घर वापस आने के लिए मनाने की कोशिश की, लेकिन उसने वापस आने से इनकार कर दिया। इसके बाद जुलाई 1994 में गांव में एक पंचायत बैठी। पंचायत ने इस शर्त के साथ आपसी सहमति से तलाक की मंजूरी दी कि पति को अपनी पत्नी को 22000 रुपए का स्थायी गुजारा भत्ता देना होगा।
⬛इसके बाद पत्नी ने दूसरी शादी कर ली और पति ने मानसिक क्रूरता के आधार तलाक की मांग की। लेकिन वो अदालत में पेश नहीं हुई। फैमिली कोर्ट ने एकतरफा तलाक खारिज करने का आदेश दिया। इसके खिलाफ पति ने हाईकोर्ट में अपील की थी।
कोर्ट ने दलीलें सुनी,
🟪 सबूतों को देखा, और कहा- पति ने ऐसा कोई भी सबूत नहीं पेश किया है, जिससे साबित हो सके कि महिला ने दूसरी शादी कर ली है। लेकिन ये भी स्पष्ट है कि दोनों काफी समय से अलग रह रहे हैं। और पति की ओर से पेश किए गए सबूतों का खंडन करने के लिए रिकॉर्ड में कुछ भी नहीं था।
🔲 फैमिली कोर्ट ने फैसले में गलती की थी। कोर्ट ने पति को तलाक की अनुमति दी। और कहा- जीवनसाथी रहे पति या पत्नी को एक साथ जीवन फिर से शुरू करने के लिए मजबूर नहीं किया जा सकता है। पति-पत्नी को शादी में हमेशा बांधे रखने की कोशिश करने से कुछ नहीं मिलता है।
