A junior auditor at @PwC in Luxembourg is getting ready to leave his job. Before he goes he goes looking for some training documents to take with him.
Instead he finds a folder that anyone in the company could open. No password. No warning. Just sitting there.
Inside are hundreds of secret deals between the Luxembourg government and some of the biggest companies on the planet. Deals that let them pay next to nothing in tax.
His name is Antoine Deltour. He copies 30,000 pages. That is the whole story. He copies a folder.
Let me explain what was actually in it, because this is where it gets interesting.
Between 2002 and 2010, PwC alone helped broker 548 of these secret tax agreements, known as tax rulings, for over 340 companies. Apple. Ikea. Pepsi. Disney. Deutsche Bank. AIG. Koch Industries. Skype. GlaxoSmithKline. Coach. Abbott Laboratories. Household names, every one of them.
The trick was simple. Companies moved profits through Luxembourg shell structures and Luxembourg quietly agreed in writing to look the other way on tax.
Some of these companies ended up paying an effective tax rate under 1 percent. In some cases as low as 0.001 percent. On billions of dollars.
Who was running Luxembourg for almost 20 years while this machine was built and protected? Jean-Claude Juncker, Prime Minister of Luxembourg until 2013.
Deltour did not leak straight to the world. In 2012 he passed the documents to French journalist Edouard Perrin, who used them for a TV documentary.
PwC noticed and filed a complaint with the Luxembourg courts. Then in November 2014, ICIJ @ICIJorg pulled together over 80 journalists across more than 30 media outlets in 26 countries and published the full scale of it as LuxLeaks.
The timing could not have been worse for Juncker, or depending how you look at it, could not have been better. He had just been elected President of the European Commission days before the story broke. The man who ran the tax haven for two decades was now running Europe.
A month later ICIJ dropped LuxLeaks 2, showing the other Big 4 accounting firms Deloitte, EY and KPMG were running the exact same playbook. This was never one bad apple. It was standard practice.
Juncker faced a no confidence vote in the European Parliament over it. He survived. Deltour was not so lucky.
December 2014, Luxembourg charges him with theft, violation of trade secrecy and fraudulent access to a computer system. He is facing up to 5 years in prison and a fine of 1,250,000 euros. For opening an unlocked folder on his way out the door.
April 2016, the criminal trial. Deltour and his colleague Raphael Halet, another former PwC employee who leaked a second batch of documents, are both convicted. Deltour gets 12 months suspended and a 1,500 euro fine. Perrin the journalist is acquitted.
Deltour appeals. Loses. Appeals again. Finally in May 2018 the Luxembourg Court of Appeal fully recognises him as a genuine whistleblower under European Court of Human Rights standards and acquits him completely.
Halet's fight took even longer. He lost his Luxembourg appeals and only won at the European Court of Human Rights Grand Chamber in 2023, nearly a decade after he first spoke up.
The European Commission that Juncker went on to lead never opened a single formal investigation into a single LuxLeaks tax ruling. Not one. It did chase Starbucks, Fiat and Amazon over separate deals, but the mountain of paperwork Deltour handed over sat there untouched.
So that is the LuxLeaks story. Build a tax avoidance machine for 20 years and get promoted to run the continent. Copy the evidence of it and spend most of a decade fighting to stay out of prison.

Een junior auditor bij @PwC in Luxemburg staat op het punt zijn baan te verlaten. Voordat hij vertrekt, gaat hij op zoek naar trainingsdocumenten om mee te nemen.
In plaats daarvan vindt hij een map die iedereen in het bedrijf kan openen. Geen wachtwoord. Geen waarschuwing. Gewoon daar.
Binnenin bevinden zich honderden geheime overeenkomsten tussen de Luxemburgse overheid en enkele van de grootste bedrijven ter wereld. Overeenkomsten waardoor ze bijna geen belasting betalen.
Zijn naam is Antoine Deltour. Hij kopieert 30.000 pagina's. Dat is het hele verhaal. Hij kopieert een map.
Laat me uitleggen wat er precies in zat, want hier wordt het interessant.
Tussen 2002 en 2010 heeft PwC alleen al geholpen bij het bemiddelen van 548 van deze geheime belastingovereenkomsten, bekend als belastinguitspraken, voor meer dan 340 bedrijven. Apple. Ikea. Pepsi. Disney. Deutsche Bank. AIG. Koch Industries. Skype. GlaxoSmithKline. Coach. Abbott Laboratories. Stuk voor stuk bekende namen.
De truc was simpel. Bedrijven sluisden winsten door Luxemburgse lege vennootschappen en Luxemburg stemde er stilzwijgend schriftelijk mee in om de andere kant op te kijken wat betreft belasting.
Sommige van deze bedrijven betaalden uiteindelijk een effectief belastingtarief van minder dan 1 procent. In sommige gevallen zelfs zo laag als 0,001 procent. Over miljarden dollars.
Wie bestuurde Luxemburg bijna 20 jaar lang terwijl deze machine werd opgebouwd en beschermd? Jean-Claude Juncker, premier van Luxemburg tot 2013.
Deltour lekte de documenten niet rechtstreeks naar de wereld. In 2012 gaf hij ze door aan de Franse journalist Edouard Perrin, die ze gebruikte voor een tv-documentaire.
PwC merkte dit op en diende een klacht in bij de Luxemburgse rechtbank. Vervolgens bracht ICIJ (@ICIJorg) in november 2014 meer dan 80 journalisten van meer dan 30 media in 26 landen bijeen en publiceerde de volledige omvang van de zaak als LuxLeaks.
De timing had voor Juncker niet slechter kunnen zijn, of, afhankelijk van hoe je het bekijkt, juist niet beter. Hij was net enkele dagen voor het uitbreken van het verhaal verkozen tot voorzitter van de Europese Commissie. De man die twintig jaar lang de belastingparadijzen had bestuurd, stond nu aan het hoofd van Europa.
Een maand later publiceerde het ICIJ LuxLeaks 2, waaruit bleek dat de andere grote vier accountantskantoren – Deloitte, EY en KPMG – precies hetzelfde draaiboek hanteerden. Het ging hier niet om één rotte appel. Het was standaardpraktijk.
Juncker kreeg te maken met een motie van wantrouwen in het Europees Parlement. Hij overleefde het. Deltour had minder geluk.
In december 2014 klaagde Luxemburg hem aan voor diefstal, schending van het handelsgeheim en frauduleuze toegang tot een computersysteem. Hij riskeerde een gevangenisstraf van maximaal 5 jaar en een boete van 1.250.000 euro. Voor het openen van een niet-vergrendelde map toen hij het huis verliet.
In april 2016 volgde het strafproces. Deltour en zijn collega Raphael Halet, een andere voormalige PwC-medewerker die een tweede lading documenten lekte, worden beiden veroordeeld. Deltour krijgt een voorwaardelijke straf van 12 maanden en een boete van 1500 euro. Journalist Perrin wordt vrijgesproken.
Deltour gaat in beroep. Verliest. Gaat opnieuw in beroep. Uiteindelijk erkent het Hof van Beroep in Luxemburg hem in mei 2018 volledig als een echte klokkenluider volgens de normen van het Europees Hof voor de Rechten van de Mens en spreekt hem volledig vrij.
De strijd van Halet duurde nog langer. Hij verloor zijn beroep in Luxemburg en won pas in 2023 bij de Grote Kamer van het Europees Hof voor de Rechten van de Mens, bijna tien jaar nadat hij zich voor het eerst had uitgesproken.
De Europese Commissie die later onder leiding van Juncker kwam te staan, heeft nooit één formeel onderzoek ingesteld naar één enkele LuxLeaks-belastinguitspraak. Geen enkele. Ze vervolgde wel Starbucks, Fiat en Amazon voor afzonderlijke deals, maar de berg documenten die Deltour had overhandigd, bleef onaangeroerd liggen. | 110 |
