Backbiting does not suddenly become permissible when the person in question belongs to a different sect or holds legal views different from our own. Disagreements are fine, but they need to be addressed with courtesy and respect. This is part of adab al-khilaf.

In other words, just because one might disagree with someone on a legal or theological point does not mean it is permitted to misrepresent their views. Wedding season means fireworks season. Whereas Anglo Saxons tend to restrict their firework activities to Bonfire Night, our lot have these ridiculous displays of showing off throughout the spring, summer, and autumn. Such activities in public areas are absolutely prohibited* in the Shariah under general “no harm” rules. The nuisance, insomnia, and fright this inflicts on people and animals is real. And these are not just one-offs, even though the wedding parents and uncles would want to think that way. It is repeated across the summer and autumn. It is incumbent upon Ulama, Imams, and Khatibs to repeatedly speak up against this, especially on Fridays. If they can’t muster the courage to deliver the message in an English sermon, they should deliver the message in both the local language and dominant ethnic language between the sermon and prayer, or straight after the Jum’ah prayer.** Not only that, it should be emphasised at the point of the Nikah contract. Nikah officiants, instead of gagging for their paltry fee of £60, should refuse to conduct the service if they cannot get an ironclad guarantee that such misadventures will not be pursued that evening. The sway our mosques and spiritual leaders hold over the unscrupulous masses is immense yet it is astonishing to them not use it. Perhaps it is the ailment of some Da’wah movements that emphasise of enjoining the good but not ever condemning the evil, or maybe it’s just the inclination to not offend. Either way, if this situation is not redeemed, it will worsen. 2025 was a particularly bad year - see links below. Muslims shopkeepers who stock fireworks should also consider their position.** The same applies to the bride and groom who should emphasise on the need to not inflict harm on residents nearby in the proceedings of their big day.** They should firmly refuse such harmful extravagance in their names. Muslim venue owners must also have measures in place.** We should be embarrassed at ourselves as a community. Abd al-Fattah Abu Ghuddah (d. 1997) stresses the importance of unity between Muslims through the works of Ibn Taymiyyah (d. 728 AH) and a short epistle by Ibn Hazm (d. 456 AH) - both of whom were chosen intentionally. An interesting choice for sure.

It is worth noting that non-obligatory actions lie on a spectrum, with some being more emphasised than others. This is why the more emphasised forms are sometimes described as 'a sunnah that is not appropriate to leave' (سنّة لا ينبغي تركها), indicating the higher expectation of performance.

بالنسبة للمشاركات السابقة، فقد اعترض بعض الأفاضل أن الاستدلال بسكوت فقهاء الحنفية في مسائل الكفارة على جواز رجوع العامي إلى مفت من خارج مذهبه هو من قبيل “حجة السكوت” (argument from silence) الضعيفة، وأن السياق إنما هو بيان الشبهة المسقطة للكفارة لا تقرير مسألة التقليد المذكورة آنفا، بل قاس ذلك بقياسات مثل ذكر الفقهاء من وطئ أجنبية أن الغسل واجب عليه حيث لا يدل هذا على جواز وطء الأجنبية. خلاصة الجواب عليه أن هذا الطرح يتجاهل وجود نصوص صريحة في كلام العلماء كالقدوري بأن العامي إذا استفتى فقيها فهو معذور. نصه كما في شرحه على مختصر الكرخي ما يلي: "فأما إذا استفتى فقيها فهو معذور، لأن العامي يلزمه الرجوع إلى فتوى الفقيه، وقد أفتاه بما اختلف فيه الفقهاء، فصار ذلك عذرا" انتهى، فهو نص مثبت لا سكوت فيه. ثم إن تشبيه سؤال مفت من الحنابلة بترتيب الفقهاء حكما شرعيا بعد ارتكاب أفعال محرمة قياس فاسد وكاسد لعدم التكافؤ بين المسألتين، فليس استفتاء فقيه حنبلي كالزنا، بل إنه لا يوجد في هذه المسألة عبر التاريخ من ذم عاميا على مذهب الحنفية من أخذ فتوى من فقيه من غير مذهبه. وعليه فإن دعوى كون هذا الاستدلال مجرد “سكوت” غير دقيقة، بل المعتمد فيه نص فقيه وإقرار فقهاء المذهب الحنفي قاطبة، بينما الافتراض المسبق بمنع العامي من مثل هذا الاستفتاء من غير الحنفية هو محل السكوت الذي يفتقر إلى الدليل. وبالله التوفيق
